1 Authorizing and directing the Department of General Services,

5 Montgomery County, in exchange for Skippack Township granting
6 and conveying certain lands to the Commonwealth to be added
7 to those existing lands at Evansburg State Park; AND <--

9 WITH THE APPROVAL OF THE GOVERNOR AND THE DEPARTMENT OF

29 The General Assembly of the Commonwealth of Pennsylvania
30 hereby enacts as follows:
1 Section 1. Conveyance in Skippack Township, Montgomery County.
2 (a) Authorization.--The Department of General Services, with
3 the approval of the Department of Conservation and Natural
4 Resources and the Governor, is hereby authorized on behalf of
5 the Commonwealth of Pennsylvania to grant and convey to Skippack
6 Township, free of restrictions on use and alienation imposed by
7 section 20 of the act of June 22, 1964 (Sp. Sess., P.L.131,
8 No.8), known as the Project 70 Land Acquisition and Borrowing
9 Act, certain lands situate in Skippack Township, Montgomery
10 County, in exchange for that certain property to be conveyed to
11 the Commonwealth of Pennsylvania in accordance with subsection
12 (c).
13 (b) Description of property to be transferred to Skippack
14 Township.--The property to be conveyed in accordance with
15 subsection (a) consists of eight tracts of land totaling
16 approximately 0.5709-acres and improvements thereon bounded and
17 more particularly described as follows:

20 0073) and Old Forty Foot Road (SR 1006) as shown on the plan
21 prepared by Traffic Planning and Design, Inc., Pottstown,

14 (c) Conveyance of property to Commonwealth.--The Department

16 Conservation and Natural Resources and the Governor, is hereby
17 authorized on behalf of the Commonwealth of Pennsylvania to
18 receive from Skippack Township certain lands situate in Skippack
19 Township, Montgomery County, in exchange for that property to be
20 conveyed to the Township in accordance with subsection (a).
21 (d) Description of property to be transferred to
22 Commonwealth.--The property to be conveyed in accordance with
23 subsection (c) consists of approximately 0.5418-acres and
24 improvements thereon bounded and more particularly described as
25 follows:
26 BEGINNING AT A POINT, a spike in the centerline of Thompson
27 Road, also known as Lesher Road, said point being located the
28 following two (2) courses and distances from the intersection of
29 the centerlines of Thompson Road and Mayhall Road:
30 1. North 65 degrees 29 minutes 06 seconds West, a distance

29 (f) Restrictive covenants.--
30 (1) The Department of Conservation and Natural

1 Resources, with the approval of the Department of General
2 Services, shall impose and record Project 70 restrictions on
3 the property to be conveyed in accordance with subsection
4 (c).
5 (2) Any conveyance authorized under subsection (a) shall
6 be made under and subject to the condition, which shall be
7 contained in the deed of conveyance, that no portion of the
8 property conveyed to Skippack Township shall be used as a
9 licensed facility, as defined in 4 Pa.C.S. § 1103 (relating
10 to definitions), or any other similar type of facility
11 authorized under State law. The condition shall be a covenant
12 running with the land and shall be binding upon Skippack
13 Township, its successors and assigns. Should Skippack
14 Township, its successors or assigns, permit any portion of
15 the property authorized to be conveyed to the Township in
16 this act to be used in violation of this subsection, the
17 title shall immediately revert to and revest in the
18 Commonwealth of Pennsylvania.
19 (g) Temporary construction easement.--
20 (1) For the duration of the construction of the Project,
21 temporary easements shall be granted by the Department of
22 General Services, with the approval of the Department of
23 Conservation and Natural Resources and the Governor, to
24 Skippack Township, or its designee, for the purpose of
