                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for the offense of
     3     aggravated harassment by prisoner.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 2703.1 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 2703.1.  Aggravated harassment by prisoner or person in
     9             custody.
    10     A person who is confined in or committed to any local or
    11  county detention facility, jail or prison or any State penal or
    12  correctional institution or other State penal or correctional
    13  facility located in this Commonwealth or otherwise in the
    14  custody of the police or other law enforcement agency commits a
    15  felony of the third degree if he, while so confined or committed
    16  or while undergoing transportation to or from such an

     1  institution or facility in or to which he was confined or
     2  committed or otherwise while in custody, intentionally or
     3  knowingly causes or attempts to cause another to come into
     4  contact with blood, seminal fluid, saliva, urine or feces by
     5  throwing, tossing, spitting or expelling such fluid or material.
     6     Section 2.  This act shall take effect in 60 days.
