AN ACT 1 To provide from the General Fund for the expenses of the 2 Executive, Legislative and Judicial Departments of the 3 Commonwealth, the public debt and for the public schools for 4 the fiscal year July 1, 2007, to June 30, 2008, for certain 5 institutions and organizations, and for the payment of bills 6 incurred and remaining unpaid at the close of the fiscal year 7 ending June 30, 2007; to provide appropriations from the 8 State Lottery Fund, the Energy Conservation and Assistance 9 Fund, the Hazardous Material Response Fund, The State Stores 10 Fund, the Milk Marketing Fund, the Home Investment Trust 11 Fund, the Emergency Medical Services Operating Fund, the 12 Tuition Payment Fund, the Banking Department Fund, the 13 Firearm Records Check Fund, the Ben Franklin Technology 14 Development Authority Fund, the Tobacco Settlement Fund and 15 the Health Care Provider Retention Account to the Executive 16 Department; to provide appropriations from the Judicial 17 Computer System Augmentation Account to the Judicial 18 Department for the fiscal year July 1, 2007, to June 30, 19 2008; to provide appropriations from the Motor License Fund 20 for the fiscal year July 1, 2007, to June 30, 2008, for the 21 proper operation of the several departments of the 22 Commonwealth and the Pennsylvania State Police authorized to 23 spend Motor License Fund moneys; to provide for the 24 appropriation of Federal funds to the Executive Department of 25 the Commonwealth and for the establishment of restricted 26 receipt accounts for the fiscal year July 1, 2007, to June 27 30, 2008, and for the payment of bills remaining unpaid at 28 the close of the fiscal year ending June 30, 2007; to provide 29 for the additional appropriation of Federal and State funds 30 from the General Fund, the State Lottery Fund and the 31 Pharmaceutical Assistance Contract for the Elderly Fund for 32 the Executive, Legislative and Judicial Departments of the 33 Commonwealth for the fiscal year July 1, 2006, to June 30,

Retroactivity. 18 Section 2002. Effective date. 19 The General Assembly of the Commonwealth of Pennsylvania 20 hereby enacts as follows: 21 PART I 22 GENERAL PROVISIONS 23 Section 101. Short title.--This act shall be known and may 24 be cited as the General Appropriation Act of 2007. 25 Section 102. Definitions.--The following words and phrases 26 when used in this act shall have the meanings given to them in 27 this section unless the context clearly indicates otherwise: 28 "Employees." Includes all directors, superintendents, bureau 29 or division chiefs, assistant directors, assistant 30 superintendents, assistant chiefs, experts, scientists, 20070H1286B1543 - 8 -
1 engineers, surveyors, draftsmen, accountants, secretaries, 2 auditors, inspectors, examiners, analysts, statisticians, 3 marshals, clerks, stenographers, bookkeepers, messengers and 4 other assistants in any department, board or commission. 5 "Expenses" and "maintenance." Includes all printing, binding 6 and stationery, food and forage, materials and supplies, 7 traveling expenses, training, motor vehicle supplies and 8 repairs, freight, express and cartage, postage, telephones and 9 telegraph rentals and toll charges, newspaper advertising and 10 notices, public advertising by or through any medium, fuel, 11 light, heat, power and water, minor construction and renovation, 12 repairs or reconstruction of equipment, buildings and 13 facilities, rent of real estate and equipment, premiums on 14 workers' compensation, insurance premiums on policies of 15 liability insurance, insurance premiums on medical payment 16 insurance and surety bonds for volunteer workers, premiums on 17 employee group life insurance and employee and retired employee 18 group hospital and medical insurance, payment of Commonwealth 19 share of Social Security taxes and unemployment compensation 20 costs for State employees, the purchase of replacement or 21 additional equipment and machinery and all other incidental 22 costs and expenses, including payment to the Department of 23 General Services of mileage and other charges for the use of 24 automobiles and rental payments for permanently assigned 25 automobiles and of expenses or costs of services incurred 26 through the Purchasing Fund. The term "expenses" also shall 27 include the medical costs for the treatment of inmates of State 28 institutions when the inmate must be transferred to an outside 29 hospital: Provided, That in no case shall the State institution 30 pay more for patient care than that provided under the State 20070H1286B1543 - 9 -
1 medical assistance program. 2 Section 103. Abbreviations.--The following abbreviations 3 when used in this act shall have the meanings given to them in 4 this section unless the context clearly indicates otherwise: 5 "ARC." State appropriations.--(a) General Fund.--The 6 following sums set forth in this act, or as much thereof as may 7 be necessary, are hereby specifically appropriated from the 8 General Fund to the several hereinafter named agencies of the 9 Executive, Legislative and Judicial Departments of the 10 Commonwealth for the payment of salaries, wages or other 11 compensation and travel expenses of the duly elected or 12 appointed officers and employees of the Commonwealth, for the 13 payment of fees for contractual services rendered, for the 14 purchase or rental of goods and services, printing, public 15 advertising by or through any medium, equipment, land and 16 buildings and for payment of any other expenses, as provided by 17 law or by this act, necessary for the proper conduct of the 18 duties, functions and activities and for the purposes 19 hereinafter set forth for the fiscal year beginning July 1, 20 2007, and for the payment of bills incurred and remaining unpaid 21 at the close of the fiscal year ending June 30, 2007. 22 (b) State Lottery Fund.--The following sums set forth in 23 this act, or as much thereof as may be necessary, are hereby 24 specifically appropriated from the State Lottery Fund to the 25 several hereinafter named agencies of the Executive Department 26 of the Commonwealth for the payment of salaries, wages or other 27 compensation and travel expenses of the duly appointed officers 28 and employees of the Commonwealth, for the payment of fees for 29 contractual services rendered, for the purchase or rental of 30 goods and services and for payment of any other expenses, as 20070H1286B1543 - 11 -
1 provided by law or by this act, necessary for the proper conduct 2 of the duties, functions and activities and for the purposes 3 hereinafter set forth for the fiscal year beginning July 1, 4 2007, and for the payment of bills incurred and remaining unpaid 5 at the close of the fiscal year ending June 30, 2007. 6 (c) Energy Conservation and Assistance Fund.--The following 7 sums set forth in this act, or as much thereof as may be 8 necessary, are hereby specifically appropriated from the Energy 9 Conservation and Assistance Fund to the several hereinafter 10 named agencies of the Executive Department of the Commonwealth 11 for the payment of fees for contractual services rendered, for 12 the purchase or rental of goods and services and for the payment 13 of any other expenses, as provided by law or by this act, 14 necessary for the proper conduct of the duties, functions and 15 activities and for the purposes hereinafter set forth for the 16 fiscal year beginning July 1, 2007, and for the payment of bills 17 incurred and remaining unpaid at the close of the fiscal year 18 ending June 30, 2007. 19 (d) Judicial Computer System Augmentation Account.--The 20 following sums set forth in this act, or as much thereof as may 21 be necessary, are hereby specifically appropriated from the 22 restricted receipt account established within the General Fund, 23 known as the Judicial Computer System Augmentation Account, to 24 the Judicial Department of the Commonwealth for the payment of 25 salaries, wages or other compensation and travel expenses, for 26 the payment of fees for contractual services rendered, for the 27 purchase or rental of goods and services and for the payment of 28 any other expenses, as provided by law or by this act, necessary 29 for the proper conduct of the duties, functions and activities 30 and for the purposes hereinafter set forth for the fiscal year 20070H1286B1543 - 12 -
1 beginning July 1, 2007, and for the payment of bills incurred 2 and remaining unpaid at the close of the fiscal year ending June 3 30, 2007. 4 (e) Emergency Medical Services Operating Fund.--The 5 following sums set forth in this act, or as much thereof as may 6 be necessary, are hereby specifically appropriated from the 7 Emergency Medical Services Operating Fund to the several 8 hereinafter named agencies of the Executive Department of the 9 Commonwealth for the payment of fees for contractual services 10 rendered, for the purchase or rental of goods and services and 11 for the payment of any other expenses, as provided by law or by 12 this act, necessary for the proper conduct of the duties, 13 functions and activities and for the purposes hereinafter set 14 forth for the fiscal year beginning July 1, 2007, and for the 15 payment of bills incurred and remaining unpaid at the close of 16 the fiscal year ending June 30, 2007. 17 (f) The State Stores Fund.--The following sums set forth in 18 this act, or as much thereof as may be necessary, are hereby 19 specifically appropriated from The State Stores Fund to the 20 hereinafter named agency of the Executive Department of the 21 Commonwealth for the payment of salaries, wages or other 22 compensation and travel expenses of the duly appointed officers 23 and employees of the Commonwealth, for the payment of fees for 24 contractual services rendered, for the purchase or rental of 25 goods and services and for the payment of any other expenses, as 26 provided by law or by this act, necessary for the proper conduct 27 of the duties, functions and activities and for the purposes 28 hereinafter set forth for the fiscal year beginning July 1, 29 2007, and for the payment of bills incurred and remaining unpaid 30 at the close of the fiscal year ending June 30, 2007. 20070H1286B1543 - 13 -
1 (g) Motor License Fund.--The following sums, or as much 2 thereof as may be necessary, are hereby appropriated from the 3 Motor License Fund to the hereinafter named agencies of the 4 Executive Department for the payment of salaries, wages and 5 other compensation and travel expenses of the duly elected or 6 appointed officers and employees of the Commonwealth, for 7 contractual services and other expenses necessary for the proper 8 conduct of the duties, functions and activities for the purposes 9 hereinafter set forth for the fiscal year beginning July 1, 10 2007, and for the payment of bills incurred and remaining unpaid 11 at the close of the fiscal year ending June 30, 2007. 12 (h) Aviation Restricted Revenue Account.--The following 13 sums, or as much thereof as may be necessary, are hereby 14 appropriated from the Aviation Restricted Revenue Account in the 15 Motor License Fund to the hereinafter named agencies of the 16 Executive Department for the purposes set forth herein for the 17 fiscal year beginning July 1, 2007, and for the payment of bills 18 incurred and remaining unpaid at the close of the fiscal year 19 ending June 30, 2007. 20 (i) Hazardous Material Response Fund.--The following sums 21 set forth in this act, or as much thereof as may be necessary, 22 are hereby specifically appropriated from the Hazardous Material 23 Response Fund to the several hereinafter named agencies of the 24 Executive Department of the Commonwealth for the payment of fees 25 for contractual services rendered, for the purchase or rental of 26 goods and services and for the payment of any other expenses, as 27 provided by law or by this act, necessary for the proper conduct 28 of the duties, functions and activities and for the purposes 29 hereinafter set forth for the fiscal year beginning July 1, 30 2007, and for the payment of bills incurred and remaining unpaid 20070H1286B1543 - 14 -
1 at the close of the fiscal year ending June 30, 2007. 2 (j) Milk Marketing Fund.--The following sums set forth in 3 this act, or as much thereof as may be necessary, are hereby 4 specifically appropriated from the Milk Marketing Fund to the 5 several hereinafter named agencies of the Executive Department 6 of the Commonwealth for the payment of salaries, wages or other 7 compensation and travel expenses of the duly appointed officers 8 and employees of the Commonwealth, for the payment of fees for 9 contractual services rendered, for the purchase or rental of 10 goods and services and for the payment of any other expenses, as 11 provided by law or by this act, necessary for the proper conduct 12 of the duties, functions and activities and for the purposes 13 hereinafter set forth for the fiscal year beginning July 1, 14 2007, and for the payment of bills incurred and remaining unpaid 15 at the close of the fiscal year ending June 30, 2007. 16 (k) Home Investment Trust Fund.--The following sums set 17 forth in this act, or as much thereof as may be necessary, are 18 hereby specifically appropriated from the Home Investment Trust 19 Fund to the hereinafter named agencies of the Executive 20 Department of the Commonwealth for the payment of salaries, 21 wages or other compensation and travel expenses of the duly 22 appointed officers and employees of the Commonwealth, for the 23 payment of fees for contractual services rendered, for the 24 purchase or rental of goods and services and for the payment of 25 any other expenses, as provided by law or by this act, necessary 26 for the proper conduct of the duties, functions and activities 27 and for the purposes hereinafter set forth for the fiscal year 28 beginning July 1, 2007, and for the payment of bills incurred 29 and remaining unpaid at the close of the fiscal year ending June 30 30, 2007. 20070H1286B1543 - 15 -

Federal augmentation appropriations.--The 22 following Federal augmentation appropriations set forth in this 23 act, or as much thereof as may be necessary, are hereby 24 specifically appropriated from the Federal augmentation funds to 25 the several hereinafter named agencies of the Executive 26 Department of the Commonwealth for the payment of the expenses 27 of implementing and carrying out the programs stated herein for 28 the fiscal year beginning July 1, 2007, and for the payment of 29 bills incurred and remaining unpaid at the close of the fiscal 30 year ending June 30, 2007. Block grants.--(a) Appropriation.--The 4 following sums set forth in this act, or as much thereof as may 5 be necessary, are hereby specifically appropriated from the 6 block grant (BG) funds to the several hereinafter named agencies 7 of the Executive Department of the Commonwealth for the 8 purposes, and under the restrictions, for which the funds are 9 provided for the fiscal year beginning July 1, 2007. 10 (b) Small Communities Development Block Grant.--The Small 11 Communities Development Block Grant (SCDBG) is to assist small 12 cities and communities that have a high concentration of 13 impoverished citizens and substandard housing to expand their 14 low-income and moderate-income housing opportunities and to meet 15 community development needs. 16 (c) Community Services Block Grant.--The Community Services 17 Block Grant (CSBG) is to provide a range of services and 18 activities having a measurable and potentially major impact on 19 the causes of poverty in the community or those areas of the 20 community where poverty is a particularly acute problem. In 21 addition, new focus may be placed on the unemployed, both old 22 and new. Local agencies may lower their eligibility requirements 23 for recipients to three months to allow greater flexibility to 24 assure proper consideration of each recipient. 25 (d) Preventive Health and Health Services Block Grant.--The 26 Preventive Health and Health Services Block Grant (PHHSBG) is 27 for the provision of preventive health and other health services 28 related to emergency medical systems, health initiative grants, 29 comprehensive public health, hypertension, fluoridation, health 30 education, risk reduction, home health, rape crisis and domestic 20070H1286B1543 - 19 -
1 violence services. 2 (e) Maternal and Child Health Services Block Grant.--The 3 Maternal and Child Health Services Block Grant (MCHSBG) is to 4 enable states to maintain and strengthen their leadership in 5 planning, promoting, coordinating and evaluating health care for 6 pregnant women, mothers, infants and children, and children with 7 special health care needs, and in providing health services for 8 mothers and children who do not have access to adequate health 9 care. 10 (f) Low-Income Home Energy Assistance Block Grant.--The Low- 11 Income Home Energy Assistance Block Grant (LIHEABG) is to help 12 lessen the impact of the high cost of energy on low-income 13 families and individuals, including energy efficiency grants for 14 low-income dwellings. No less than 15% of the LIHEABG funds 15 received shall be used for weatherization. LIHEABG funds 16 received pursuant to a Presidential release of contingency funds 17 shall be exempt from the 15% requirement. 18 (g) Social Services Block Grant.--The Social Services Block 19 Grant (SSBG) is for the provision of social services to eligible 20 persons. 21 (h) Mental Health Services Block Grant.--The Mental Health 22 Services Block Grant (MHSBG) provides funds for the provision of 23 services to adults with serious mental illness or children with 24 serious emotional disturbance. 25 (i) Substance Abuse Block Grant.--The Substance Abuse Block 26 Grant (SABG) provides funds to establish and maintain programs 27 to combat alcohol and drug abuse. 28 (j) Child Care and Development Fund Block Grant.--The Child 29 Care and Development Fund Block Grant (CCDFBG) is for the 30 provision of direct child care or to increase the quality and 20070H1286B1543 - 20 -

Contracts prerequisite to encumbering or 6 committing funds.--Funds for the purchase of supplies, materials 7 and equipment shall not be deemed to be committed or encumbered 8 until contracts covering the purchase have been entered into 9 with the vendors. 10 Section 1794. Minority business set-asides.--(a) Each 11 department or other instrumentality of the Commonwealth listed 12 in Subpart B authorized to contract for buildings, highways, 13 commodities, equipment, supplies or services shall report to the 14 General Assembly all information pertinent to anticipated 15 procurement needs at the beginning of each fiscal year and each 16 fiscal quarter thereafter. 17 (b) As used in this section, the term "minority business" 18 means a minority business enterprise as defined in the act of 19 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania 20 Minority Business Development Authority Act. 21 Section 1795. Appropriation of funds from miscellaneous 22 sources.--(a) In addition to the amounts appropriated by this 23 part, moneys received in payment for food and household supplies 24 furnished to employees and other persons, except inmates, by an 25 institution, and moneys received from the proceeds from the sale 26 of any products of the soil, meats, livestock, timber or other 27 materials sold by the department shall be paid into the General 28 Fund and are hereby appropriated out of the General Fund to the 29 several respective institutions for the operation and 30 maintenance of the institutions. 20070H1286B1543 - 191 -
1 (b) In addition to the amounts appropriated by this part, 2 all moneys received from any other source, except the Federal 3 Government, as contributions for the programs provided herein or 4 as payment for services or materials furnished by one 5 institution to another, except those collections designated as 6 revenues, shall be paid into the General Fund and are hereby 7 appropriated out of the General Fund for the purposes of the 8 respective appropriations. 9 (c) In addition to any funds specifically appropriated by 10 this part, all moneys received by a department or agency of the 11 Commonwealth from any other sources, except the Federal 12 Government, as contributions or supplements to the department or 13 agency for a program or administration of an act included in 14 this part shall be paid into the General Fund and credited to 15 the appropriation for that program or administration of the act. 16 Section 1796. Lapsing of unused funds.--(a) Except as 17 otherwise provided by law or by this section, that part of all 18 appropriations in Part XVIII unexpended, uncommitted or 19 unencumbered as of June 30, 2007, shall automatically lapse as 20 of that date. 21 (b) The appropriations in section 1723 to the Pennsylvania 22 Emergency Management Agency for April 2005 storm disaster - 23 public assistance shall be a continuing appropriation until June 24 30, 2007. 25 Section 1797. Construction with prior appropriation acts.-- 26 Any appropriation in Subparts B, C, D and E of this part which 27 is the same or similar to any appropriation in the act of July 28 2, 2006 (P.L. , No.2A), known as the General Appropriation 29 Act of 2006, or the act of July 2, 2006 (P.L. , No.6A) 30 entitled, "An act making an appropriation from a restricted 20070H1286B1543 - 192 -
1 revenue account within the General Fund and from Federal 2 augmentation funds to the Pennsylvania Public Utility 3 Commission," shall replace that appropriation. 4 Section 1798. Deduction of expended appropriations under 5 prior law.--Any money which has been appropriated and expended 6 under the act of July 2, 2006 (P.L. , No.2A), known as the 7 General Appropriation Act of 2006, or the act of July 2, 2006 8 (P.L. , No.6A) entitled, "An act making an appropriation 9 from a restricted revenue account within the General Fund and 10 from Federal augmentation funds to the Pennsylvania Public 11 Utility Commission," shall be deducted from the corresponding 12 appropriation in this part. 13 PART XVIII 14 SPECIAL PROVISIONS FOR FEDERAL FUNDS 15 FOR 2007-2008 16 Section 1801. General Fund repository for Federal funds.-- 17 All moneys received from the Federal Government as contributions 18 or supplements to the departments or agencies of the 19 Commonwealth or the programs herein provided shall be paid into 20 the General Fund. 21 Section 1802. Limitation on encumbering or spending Federal 22 funds.--Federal funds shall be encumbered or spent only to the 23 extent that such funds are estimated as being available during 24 the fiscal year of the Commonwealth. 25 Section 1803. Appropriation of prior unspent Federal 26 funds.--(a) Any Federal money which has been previously 27 appropriated by the General Assembly and authorized or allocated 28 by the Federal Government but remains unspent from prior fiscal 29 years and will not be renewed for fiscal year 2007-2008 is 30 hereby appropriated. 20070H1286B1543 - 193 -
1 (b) The Federal appropriations to the Department of Public 2 Welfare include any prior earnings that may be received during 3 fiscal year 2007-2008. In addition to the amounts specifically 4 appropriated herein to the Department of Public Welfare, all 5 moneys appropriated from the Federal Government during any 6 previous fiscal year which are expected to be received as 7 reimbursements may be carried forward until June 30, 2008, to 8 the extent that obligations are carried forward. In addition, 9 any reimbursements actually received to support such obligations 10 may also be carried forward. 11 Section 1804. Subgrants between Federal fund 12 appropriations.--Subgrants may be made between appropriations 13 without further approval of the General Assembly. The Secretary 14 of the Budget shall submit a list of subgrants to the chairman 15 and minority chairman of the Appropriations Committee of the 16 Senate and the chairman and minority chairman of the 17 Appropriations Committee of the House of Representatives 18 quarterly. No subgrant to a State agency, however, may be made 19 from a restricted receipt account without a specific 20 appropriation by the General Assembly. 21 Section 1805. Utilization of emergency Federal funds.--(a) 22 Federal funds available for costs and damages resulting from 23 natural disasters or civil disobedience may be added to an 24 appropriation contained in this act or to funds appropriated or 25 may be used for the purposes prescribed by the Federal 26 Government. 27 (b) In addition to the moneys appropriated by this act, all 28 moneys received from the Federal Government for the purpose of 29 disaster assistance or relief, or other moneys received as a 30 direct result of terrorist acts, moneys for homeland security 20070H1286B1543 - 194 -
1 and defense and moneys for avian flu/pandemic preparedness shall 2 be paid into the General Fund and are hereby appropriated out of 3 the General Fund to the departments, boards, commissions or 4 agencies designated by the Governor. 5 (c) In the event of any emergency situation in which the 6 General Assembly cannot act in sufficient time, the Governor is 7 authorized through executive authorization to provide up to 8 $10,000,000 in Federal funds to alleviate the emergency 9 situation. For the purposes of this section, "emergency" is 10 defined as any situation in which there is a chance of or which 11 may result in substantial human suffering. 12 Section 1806. Transfer of funds from TANFBG to CCDFBG and 13 SSBG.--In accordance with Federal law which permits the transfer 14 of funds from the TANFBG to the CCDFBG and SSBG, the Department 15 of Public Welfare, upon approval of the Secretary of the Budget, 16 may make such transfers of funds provided that any such transfer 17 will not result in a deficit in any appropriation from which 18 funds are transferred. The Secretary of the Budget shall provide 19 ten days prior notification of any such transfers to the 20 chairman and the minority chairman of the Appropriations 21 Committee of the Senate and the chairman and minority chairman 22 of the Appropriations Committee of the House of Representatives. 23 PART XIX 24 MISCELLANEOUS PROVISIONS FOR 2007-2008 25 Section 1901. Prior laws unaffected.--Except as provided in 26 section 253, this act is not intended to be inconsistent with or 27 to repeal any provision of any act enacted at this or any prior 28 session of the General Assembly regulating the purchase of 29 supplies, the ordering of printing and binding, the purchase, 30 maintenance and use of automobiles, the method of making 20070H1286B1543 - 195 -
1 payments from the State Treasury for any purpose or the 2 functioning of any administrative department, board or 3 commission. 4 Section 1902. Compliance with other law before funds 5 available.--No appropriation made by this act to any department, 6 board, commission or agency of the Executive Department shall be 7 available unless and until the department, board, commission or 8 agency has complied with sections 615 and 616 of the act of 9 April 9, 1929 (P.L.177, No.175), known as The Administrative 10 Code of 1929. 11 Section 1903. Contracts prerequisite to encumbering or 12 committing funds.--Funds available to agencies, boards, 13 departments, commissions, or other governmental entities under 14 this act for the procurement of supplies, services or 15 construction shall not be available for payment of, or to be 16 committed to or encumbered for payment of, any such procurement 17 unless and until the agency, board, department or other 18 governmental entity has complied with all of the requirements 19 applicable to the procurement that are set out in 62 Pa.C.S. 20 (relating to procurement) and in the policies, procedures and 21 regulations instituted in accordance with that code. 22 Section 1904. 1 XI, XII, XIII, XIV, XV and XVI unexpended, uncommitted or 2 unencumbered as of June 30, 2008, shall automatically lapse as 3 of that date. 4 (b) The appropriation in Part II to the Department of 5 Community and Economic Development for family savings accounts 6 shall be a continuing appropriation. 7 (c) The appropriation in Part II to the Pennsylvania 8 Emergency Management Agency for June 2006 Flood Disaster Relief 9 shall be a continuing appropriation. 10 (d) The appropriations in Part II to the Legislative 11 Department shall be continuing appropriations. 12 (e) The appropriations in Part II to the Supreme Court for 13 the unified judicial security programs shall be a continuing 14 appropriation. 15 (f) The appropriation in Part II for county court 16 reimbursements for the gun courts shall be a continuing 17 appropriation until June 30, 2009. 18 Section 1907. Appellate courts appropriation contingency.-- 19 The funds appropriated in Part II to the Supreme, Superior and 20 Commonwealth Courts for justice and judge expenses are 21 contingent upon a vouchered expense account plan being continued 22 by the Supreme Court. 23 Section 1908. Transfer of excess funds.--The Governor may 24 transfer any excess money in those funds receiving proceeds of 25 Commonwealth of Pennsylvania general obligation bonds in excess 26 of the amount necessary for the purposes for which the bonds 27 were issued to the appropriate sinking fund for payment of debt 28 service due on outstanding bonds. If such excess funds, together 29 with any available balance, exceed the amount of debt service 30 remaining to be paid, the funds shall be transferred to the 20070H1286B1543 - 198 -
1 General Fund or to the appropriate special fund responsible for 2 such debt service. 3 PART XX 4 EFFECTIVE DATE 5 Section 2001. Retroactivity.--This act shall be retroactive 6 as follows: 7 (1) The provisions of Part XVIII of this act shall be 8 retroactive to June 30, 2007. 9 (2) Except as provided in paragraph (1), the remainder 10 of this act shall be retroactive to July 1, 2007. 11 Section 2002.
