                                     AN ACT

     1  Amending the act of May 23, 1945 (P.L.926, No.369), entitled, as
     2     amended "An act for the protection of the public health by
     3     regulating the conduct and operation of public eating and
     4     drinking places within this Commonwealth; requiring their
     5     licensing; imposing certain duties on the Department of
     6     Agriculture of this Commonwealth and on the local health
     7     authorities; and providing penalties," further providing for
     8     requirements of public eating and drinking places.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Section 9 of the act of May 23, 1945 (P.L.926,
    12  No.369), referred to as the Public Eating and Drinking Place
    13  Law, is amended to read:
    14     Section 9.  In every public eating or drinking place,
    15  kitchens, dining rooms, cellars, ice-boxes, refrigerators and
    16  all places where foods are prepared, kept or stored and all
    17  kitchen-ware, table-ware, glass-ware, cutlery, utensils,
    18  containers or other utensils and machinery used in moving,
    19  handling, cutting, mixing, preparing or serving foods shall be


     1  kept in a clean and sanitary condition and be protected from
     2  contamination by potential food allergens, dust, dirt, insects
     3  and vermin in the manner prescribed by the regulations of the
     4  department. The clothing and hands of employes shall at all
     5  times be clean and sanitary. No domestic pets or other animals
     6  shall be permitted where food or drink is prepared, handled or
     7  stored. No person shall be permitted to use for sleeping
     8  purposes any room or place in any public eating or drinking
     9  place which is regularly and customarily used for the
    10  preparation, handling, storing or serving of food. Standard food
    11  allergy information shall be posted in the food preparation area
    12  of every public eating and drinking place. Employes shall
    13  receive food allergy training in the manner prescribed by
    14  regulations of the department.
    15     Section 2.  This act shall take effect in 60 days.
