AN ACT 1 Amending the act of April 6, 1951 (P.L.69, No.20), entitled "An 2 act relating to the rights, obligations and liabilities of 3 landlord and tenant and of parties dealing with them and 4 amending, revising, changing and consolidating the law 5 relating thereto," providing for disclosure of prior use for 6 the manufacture of certain controlled substances. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. The act of April 6, 1951 (P.L.69, No.20), known 10 as The Landlord and Tenant Act of 1951, is amended by adding a 11 section to read: 12 Section 207. Disclosure of Prior Use for the Manufacture of 13 Certain Controlled Substances.--For any lease subject to this 14 act, the landlord shall provide notice to a prospective tenant 15 if the property has been used for manufacturing methamphetamine, 16 ecstasy or lysergic acid diethylamide (LSD). The tenant shall 17 acknowledge receipt of the notice before signing a rental
1 agreement for the property, or in the case where there is no 2 written agreement, before taking possession of the property. The 3 notice shall be attached to the rental agreement, if any. If the 4 landlord does not fully comply with this section, the tenant 5 shall have the option to void the lease and the landlord shall 6 be subject to a civil penalty of one thousand dollars ($1,000) 7 and shall be liable for any harm resulting from failure to 8 comply with this section. 9 Section 2.
