AN ACT 1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania 2 Consolidated Statutes, further providing for the offense of 3 sale or transfer of firearms. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 6111(g)(2) and (h) heading and (1) of 7 Title 18 of the Pennsylvania Consolidated Statutes are amended 8 and subsection (h) is amended by adding a paragraph to read: 9 § 6111. Sale or transfer of firearms. 10 * * * 11 (g) Penalties.-- 12 * * * 13 (2) Any person, licensed dealer, licensed manufacturer 14 or licensed importer who knowingly or intentionally sells, 15 delivers or transfers a firearm under circumstances intended 16 to provide a firearm to any person, purchaser or transferee 17 who is unqualified or ineligible to control, possess or use a
1 firearm under this chapter [commits a felony of the third 2 degree and shall in addition be subject to revocation of the 3 license to sell firearms for a period of three years.] shall 4 be punished as provided in subsection (h). 5 * * * 6 (h) [Subsequent violation penalty] Mandatory minimum 7 sentence.-- 8 (1) [A second or subsequent violation of this section 9 shall be a felony of the second degree and shall be 10 punishable by a mandatory minimum sentence of imprisonment of 11 five years. A second or subsequent offense shall also result 12 in permanent revocation of any license to sell, import or 13 manufacture a firearm.] The following violations shall be a 14 felony of the second degree and shall be punishable by a 15 mandatory minimum sentence of imprisonment of five years: 16 (i) a second or subsequent violation of this 17 section, regardless of whether a firearm was involved; or 18 (ii) a violation of subsection (g)(2). 19 (1.1) A violation under paragraph (1)(i) or (ii) shall 20 also result in the permanent revocation of any license to 21 sell, import or manufacture a firearm. 22 * * * 23 Section 2.
