AN ACT 1 Amending Title 35 (Health and Safety) of the Pennsylvania 2 Consolidated Statutes, requiring the development and 3 implementation of a Statewide Traffic and Weather Alert 4 System; defining "emergency and weather operations," 5 "incident management," "traffic and roadway monitoring," 6 "traffic management," and "traveler information and 7 dissemination"; and further providing for powers and duties. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. Section 7102 of Title 35 of the Pennsylvania 11 Consolidated Statutes is amended by adding definitions to read: 12 § 7102. Definitions. 13 The following words and phrases when used in this part shall 14 have, unless the context clearly indicates otherwise, the 15 meanings given to them in this section:
1 * * * 2 "Emergency and weather operations." The term includes, but 3 shall not be limited to, surveillance, monitoring, traffic 4 control and response and recovery and evacuation procedures. 5 * * * 6 "Incident management." The term includes, but shall not be 7 limited to, the surveillance, detection and management of 8 disaster emergencies, emergency services and local emergencies 9 as defined by this part. 10 * * * 11 "Traffic and roadway monitoring." The term includes, but 12 shall not be limited to, closed-caption cameras, permanent 13 message signs, traffic surveillance, deployed road closure 14 systems and roadway congestion. 15 "Traffic management." The term includes, but shall not be 16 limited to, surveillance, road and ramp closures, ramp control, 17 lane management, signal coordination and control, priority 18 access routes and emergency evacuation. 19 "Traveler information and dissemination." The term includes, 20 but shall not be limited to, roadway information, a 511 traveler 21 information system, highway advisory radio and a permanent 22 dynamic message service. 23 * * * 24 Section 2. Section 7313(6) of Title 35 is amended to read: 25 § 7313. Powers and duties. 26 The agency shall have the following powers and duties: 27 * * * 28 (6) To supply appropriate Commonwealth and local 29 agencies and officials and the general public with 30 precautionary notices, watches and warnings relating to 20070H0663B0750 - 2 -
1 actual and potential disasters and to provide a flow of 2 official information and instructions to the general public 3 through all means available before, during and after an 4 emergency. The agency shall, in conjunction with the 5 Pennsylvania Department of Transportation and the 6 Pennsylvania State Police, establish, coordinate and 7 implement an Intelligent Transportation Systems and 8 Operations Program that incorporates a 24-hour-a-day, 365- 9 days-a-year, real-time program which shall include, but not 10 be limited to, traffic and roadway monitoring, incident 11 management, traveler information and dissemination, traffic 12 management and emergency and weather operations. The agency 13 shall implement a program of integrated flood warning systems 14 among political subdivisions. The agency shall establish 15 coordinated flood notification and early warning systems 16 along prescribed major river basins and selected tributaries 17 thereof in this Commonwealth. The council shall oversee the 18 implementation of this program and review its operations 19 every calendar quarter and shall make recommendations to the 20 General Assembly every year. 21 * * * 22 Section 3.
