                                     AN ACT

     1  Amending Title 62 (Procurement) of the Pennsylvania Consolidated
     2     Statutes, providing for the procurement of fuel-efficient
     3     vehicles.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Sections 3732 and 3734 of Title 62 of the
     7  Pennsylvania Consolidated Statutes are amended to read:
     8  § 3732.  Definitions.
     9     The following words and phrases when used in this subchapter
    10  shall have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Fuel-efficient vehicle."  Any of the following:
    13         (1)  A hybrid electric vehicle as defined under 75
    14     Pa.C.S. § 102 (relating to definitions).
    15         (2)  An alternative fuel vehicle as defined under section
    16     2 of the act of November 29, 2004 (P.L.1376, No.178), known


     1     as the Alternative Fuels Incentive Act.
     2         (3)  A vehicle with a Federal fuel economy rating of at
     3     least 45 miles per gallon.
     4     "Motor vehicle."  A passenger car or a truck as those terms
     5  are defined under 75 Pa.C.S. § 102 (relating to definitions).
     6     "Procure."  To acquire by purchase, lease or rent. The term
     7  does not include any rentals or leases where the term thereof is
     8  less than one month.
     9  § 3734.  Contract provisions.
    10     (a)  Motor vehicles to be manufactured in North America.--All
    11  government agencies shall procure only motor vehicles which are
    12  manufactured in North America. A motor vehicle is manufactured
    13  in North America if a substantial majority of the principal
    14  components are assembled into the final product in an assembly
    15  plant in North America. Contract documents for the procurement
    16  of motor vehicles shall contain a provision that the vehicles
    17  procured by the government agency shall be manufactured in North
    18  America.
    19     (a.1)  Fuel-efficient vehicles.--By 2010, at least 50% of all
    20  vehicles procured by Commonwealth agencies shall be fuel-
    21  efficient vehicles.
    22     (b)  Exception.--This section shall not apply where the head
    23  of the government agency states in writing that it is
    24  inconsistent with the public interest or that the cost is
    25  unreasonable.
    26     Section 2.  This act shall take effect in 60 days.
