AN ACT 1 Amending Title 42 (Judiciary and Judicial Procedure) of the 2 Pennsylvania Consolidated Statutes, providing for 3 compensation of certain judges and for exclusive jurisdiction 4 of Supreme Court. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Chapter 17 of Title 42 of the Pennsylvania 8 Consolidated Statutes is amended by adding a subchapter to read: 9 SUBCHAPTER C 10 COMPENSATION 11 Sec. 12 1741. Compensation of judges. 13 1742. Exclusive jurisdiction of Supreme Court. 14 § 1741. Compensation of judges. 15 (a) Supreme Court.--No justice of the Supreme Court shall 16 receive any annual salary insofar as that salary is based on any
1 increase in the base salary of a circuit court judge of the 2 United States Court of Appeals that occurs after the effective 3 date of this section. 4 (b) Superior Court and Commonwealth Court.--No judge of the 5 Superior Court or Commonwealth Court shall receive any annual 6 salary insofar as that salary is based on any increase in the 7 base salary of a judge of the United States District Court that 8 occurs after the effective date of this section. 9 (c) Other courts.--No judge of a court of common pleas or 10 Philadelphia Municipal Court, Philadelphia Traffic Court or 11 magisterial district justice shall receive any annual salary 12 insofar as that annual salary is based on any increase in the 13 base salary of a United States Magistrate Judge that occurs 14 after the effective date of this section. 15 § 1742. Exclusive jurisdiction of Supreme Court. 16 The Pennsylvania Supreme Court shall have exclusive 17 jurisdiction to hear any challenge to or to render a declaratory 18 judgment concerning the constitutionality of this subchapter. 19 The Supreme Court is authorized to take such action as it deems 20 appropriate, consistent with the Supreme Court retaining 21 jurisdiction over such a matter, to find facts or to expedite a 22 final judgment in connection with such a challenge or request 23 for declaratory relief. 24 Section 2.
