                                     AN ACT

     1  Amending the act of August 26, 1971 (P.L.351, No.91), entitled
     2     "An act providing for a State Lottery and administration
     3     thereof; authorizing the creation of a State Lottery
     4     Commission; prescribing its powers and duties; disposition of
     5     funds; violations and penalties therefor; exemption of prizes
     6     from State and local taxation and making an appropriation,"
     7     further providing for Federal programs.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 2103 of the act of August 26, 1971
    11  (P.L.351, No.91), known as the State Lottery Law, amended July
    12  7, 2006 (P.L.1061, No.111), is amended to read:
    13  Section 2103.  Federal programs.
    14     (a)  General rule.--If the Federal Government enacts pharmacy
    15  programs similar to PACE or PACENET, the State programs shall be
    16  construed to only supplement the Federal pharmacy programs. All


     1  persons qualified for coverage under a Federal pharmacy program,
     2  including the prescription drug benefit program provided by the
     3  Medicare Prescription Drug, Improvement, and Modernization Act
     4  of 2003 (Public Law 108-173, 117 Stat. 2066), may be required by
     5  the department to utilize the Federal program before utilizing
     6  any State program.
     7     (b)  Deposit of revenues.--Any revenues received by the
     8  Commonwealth as a direct result of the enactment of any Federal
     9  Government program similar to PACE or PACENET shall be deposited
    10  in the State Lottery Fund to be utilized to further supplement
    11  programs that benefit Pennsylvanians who are 65 years of age or
    12  older.
    13     (c)  Utilization of savings.--Any savings realized by the
    14  State Lottery Fund as a direct result of the enactment of any
    15  Federal Government program similar to PACE or PACENET shall only
    16  be utilized to further supplement programs that benefit
    17  Pennsylvanians who are 65 years of age or older.
    18     Section 2.  This act shall take effect in 60 days.
