           D. WHITE, KASUNIC, ARMSTRONG, BROWNE, BOSCOLA, RAFFERTY,
           LAVALLE, FONTANA, PUNT, PILEGGI, REGOLA, PICCOLA, RHOADES,
           WENGER, WAUGH, COSTA, KITCHEN, FUMO, O'PAKE AND LOGAN,

        SENATOR GREENLEAF, JUDICIARY, AS AMENDED, JUNE 13, 2006

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for methamphetamine
     3     laboratories.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 7508.2.  Methamphetamine laboratories.
     9     (a)  Offense defined.--
    10         (1)  A person commits the offense of operating a
    11     methamphetamine laboratory if the person knowingly causes a
    12     chemical reaction involving ephedrine, pseudoephedrine or
    13     phenylpropanolamine or any of their salts, optical isomers or
    14     salts of optical isomers for the purpose of manufacturing
    15     methamphetamine or preparing a precursor substance for the
    16     manufacture of methamphetamine.
    17         (2)  Except as provided in subsection (c) (B), an offense  <--

     1     under this subsection constitutes a felony OF THE SECOND       <--
     2     DEGREE.
     3     (b)  Drug-free school zone.--A person who violates subsection
     4  (a) commits a felony OF THE FIRST DEGREE if the chemical          <--
     5  reaction occurs within 1,000 feet of the real property on which
     6  is located a public, private or parochial school, a college or
     7  university or a nursery school or day care center, or within 250
     8  feet of the real property on which is located a recreation
     9  center or playground and shall be sentenced as provided in        <--
    10  section 6317 (relating to drug-free school zones). PLAYGROUND.    <--
    11     (c)  Exclusion.--This section does not apply to the
    12  manufacturing operation of a licensed pharmaceutical company in
    13  the normal course of business.
    14     Section 2.  This act shall take effect in 60 days.
