AN ACT 1 Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An 2 act to consolidate, editorially revise, and codify the public 3 welfare laws of the Commonwealth," providing for home 4 infusion therapy to be available to all eligible recipients 5 and adding a definition of "home infusion therapy." 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. The act of June 13, 1967 (P.L.31, No.21), known 9 as the Public Welfare Code, is amended by adding a section to 10 read: 11 Section 443.9. Home Infusion Therapy.--(a) The department 12 shall ensure that home infusion therapy shall be a required 13 benefit and available to all eligible recipients. There are 14 three distinct components to the provision of home infusion 15 therapy: 16 (1) prescription pharmaceuticals; 17 (2) professional pharmacy services, which includes: 18 dispensing, clinical monitoring, care coordination, supplies and 19 equipment; other multiple categories of pharmacy professional
1 services necessary for safe and effective administration of the 2 drug therapies; and expected adherence to professional standards 3 of practice related to quality care and applicable laws and 4 regulations, administrative services and support services; and 5 (3) home infusion nursing visits. 6 The department shall reimburse providers in a manner that is 7 consistent with the services provided and pay separately for 8 each of the defined components. 9 (b) For the purposes of this section, "home infusion 10 therapy" shall mean the preparation of parenteral 11 pharmaceuticals, which are prescription drugs and biologics 12 administered through catheters and/or needles, provided in a 13 patient's home, other place of residence or outpatient setting. 14 Parenteral routes of administration include intravenous, 15 intraspinal, intrathecal, intra-arterial, subcutaneous and 16 intramuscular. Home infusion therapy also involves clinical 17 pharmacy monitoring as well as clinical nursing for the 18 administration, teaching and oversight of the patient's 19 prescribed parenteral therapy. 20 Section 2.
