                                     AN ACT

     1  Amending Title 65 (Public Officers) of the Pennsylvania
     2     Consolidated Statutes, further providing for open meetings
     3     and for General Assembly meetings covered.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Sections 704 and 712 of Title 65 of the
     7  Pennsylvania Consolidated Statutes are amended to read:
     8  § 704.  Open meetings.
     9     (a)  General rule.--Official action and deliberations by a
    10  quorum of the members of an agency shall take place at a meeting
    11  open to the public unless closed under section 707 (relating to
    12  exceptions to open meetings), 708 (relating to executive
    13  sessions) or 712 (relating to General Assembly meetings
    14  covered).
    15     (b)  Election days.--No agency may conduct an open meeting
    16  under this section on the day of any general election, municipal
    17  election or primary election, as these terms are defined in

     1  section 102 of the act of June 3, 1937 (P.L.1333, No.320), known
     2  as the Pennsylvania Election Code.
     3  § 712.  General Assembly meetings covered.
     4     (a)  General rule.--Notwithstanding any other provision, for
     5  the purpose of this chapter, meetings of the General Assembly
     6  which are covered are as follows: all meetings of committees
     7  where bills are considered, all hearings where testimony is
     8  taken and all sessions of the Senate and the House of
     9  Representatives. Not included in the intent of this chapter are
    10  caucuses or meetings of any ethics committee created pursuant to
    11  the Rules of the Senate or the House of Representatives.
    12     (b)  Election days.--The General Assembly may not conduct any
    13  meetings under this section on the day of any general election,
    14  municipal election or primary election, as these terms are
    15  defined in section 102 of the act of June 3, 1937 (P.L.1333,
    16  No.320), known as the Pennsylvania Election Code.
    17     Section 2.  This act shall take effect in 60 days.
