                                     AN ACT

     1  Requiring the Commissioner of the Pennsylvania State Police to
     2     prepare a plan for electronic transmission of fingerprints.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Electronic
     7  Transmission of Fingerprints Act.
     8  Section 2.  Pennsylvania State Police plan for electronic
     9                 transmission of fingerprints.
    10     (a)  Commissioner.--The Commissioner of the Pennsylvania
    11  State Police shall, within 180 days of the effective date of
    12  this section, submit a plan to the Governor and the General
    13  Assembly for implementing the electronic transmission of
    14  fingerprints by the Pennsylvania State Police to the Federal
    15  Bureau of Investigation for any individual whose Federal
    16  criminal history record information is required by Federal or


     1  State law as a condition of employment or as a volunteer or
     2  person with unsupervised access to children, the elderly or
     3  individuals with disabilities pursuant to sections 3 and 5 of
     4  the National Child Protection Act of 1993 (Public Law 103-209,
     5  42 U.S.C. §§ 5119a and 5119c).
     6     (b)  Plan contents.--The plan shall identify as follows:
     7         (1)  The extent to which the electronic transmission of
     8     fingerprints rather than transmission of fingerprint cards to
     9     the Federal Bureau of Investigation will expedite the
    10     retrieval of Federal criminal history record information and
    11     accelerate the application process.
    12         (2)  State costs for implementing the electronic
    13     transmission of fingerprints for purposes of obtaining
    14     Federal criminal history record information for noncriminal
    15     justice purposes.
    16         (3)  Recommendations for changes in fees for requests for
    17     Federal or State criminal history record information.
    18         (4)  Whether the Pennsylvania State Police or a private
    19     entity under contract with the Commonwealth should administer
    20     requests for Federal or State criminal record history
    21     information for noncriminal justice purposes.
    22  Section 10.  Effective date.
    23     This act shall take effect immediately.
