AN ACT 1 Amending Titles 42 (Judiciary and Judicial Procedure), 46 2 (Legislature) and 71 (State Government) of the Pennsylvania 3 Consolidated Statutes, providing for compensation; and making 4 an inconsistent repeal. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Title 42 of the Pennsylvania Consolidated 8 Statutes is amended by adding a chapter to read: 9 CHAPTER 18 10 COMPENSATION 11 Sec. 12 1801. Definitions. 13 1802. Supreme Court. 14 1803. Superior Court. 15 1804. Commonwealth Court. 16 1805. Courts of common pleas. 17 1806. Philadelphia Municipal Court. 18 1807. Philadelphia Traffic Court. 19 1808. Magisterial district judges. 20 1809. Senior judges. 21 1809.1. District attorneys. 22 1810. Cost of living. 23 § 1801. Definitions. 24 The following words and phrases when used in this chapter 25 shall have the meanings given to them in this section unless the 26 context clearly indicates otherwise: 27 "Base salary." The salary for the designated Federal 28 official as of January 1, 2005. 29 § 1802. Supreme Court. 30 (a) Justices.--Except as set forth in subsection (b), a 20050H1521B2570 - 3 -
1 justice of the Supreme Court shall receive as an annual salary 2 the base salary of a circuit judge of the United States Court of 3 Appeals plus all adjustments under section 1810 (relating to 4 cost of living). 5 (b) Chief Justice.--In addition to the salary under 6 subsection (a), the Chief Justice of the Supreme Court shall 7 receive $5,000. 8 § 1803. Superior Court. 9 (a) Judges.--Except as set forth in subsection (b), a judge 10 of the Superior Court shall receive as an annual salary the base 11 salary of a judge of the United States District Court plus all 12 adjustments under section 1810 (relating to cost of living). 13 (b) President judge.--In addition to the salary under 14 subsection (a), the President Judge of the Superior Court shall 15 receive $5,000. 16 § 1804. Commonwealth Court. 17 (a) Judges.--Except as set forth in subsection (b), a judge 18 of the Commonwealth Court shall receive as an annual salary the 19 base salary of a judge of the United States District Court plus 20 all adjustments under section 1810 (relating to cost of living). 21 (b) President Judge.--In addition to the salary under 22 subsection (a), the President Judge of the Commonwealth Court 23 shall receive $5,000. 24 § 1805. Courts of common pleas. 25 (a) Judges.--Except as set forth in subsection (b), a judge 26 of a court of common pleas shall receive as an annual salary the 27 base salary of a United States magistrate judge plus all 28 adjustments under section 1810 (relating to cost of living). 29 (b) President judges.--In addition to the salary under 30 subsection (a), the president judge of a court of common pleas 20050H1521B2570 - 4 -
1 shall receive additional compensation in accordance with the 2 following schedule: 3 (1) Allegheny County, $2,500. 4 (2) Philadelphia County, $3,000. 5 (3) Judicial districts having six or more judges, 6 $1,300. 7 (4) Judicial districts having one to five judges, $650. 8 (5) Administrative judges of the divisions of the Court 9 of Common Pleas of Philadelphia County with divisions of six 10 or more judges, $1,300. 11 (6) Administrative judges of the divisions of the Court 12 of Common Pleas of Philadelphia County with divisions of five 13 or fewer judges, $650. 14 (7) Administrative judges of the divisions of the Court 15 of Common Pleas of Allegheny County with divisions of six or 16 more judges, $1,300. 17 (8) Administrative judges of the divisions of the Court 18 of Common Pleas of Allegheny County with divisions of five or 19 fewer judges, $650. 20 § 1806. Philadelphia Municipal Court. 21 (a) Judges.--Except as set forth in subsection (b), a judge 22 of the Philadelphia Municipal Court shall receive as an annual 23 salary the base salary of a United States magistrate judge minus 24 $3,450 plus all adjustments under section 1810 (relating to cost 25 of living). 26 (b) President judge.--In addition to the salary under 27 subsection (a), the President Judge of the Philadelphia 28 Municipal Court shall receive $2,250. 29 § 1807. Philadelphia Traffic Court. 30 (a) Judges.--Except as set forth in subsection (b), a judge 20050H1521B2570 - 5 -
1 of the Philadelphia Traffic Court shall receive an annual salary 2 equal to 50% of the annual salary determined under section 3 1805(a) (relating to courts of common pleas) plus $3,800. 4 (b) President judge.--In addition to the salary under 5 subsection (a), the President Judge of the Philadelphia Traffic 6 Court shall receive $650. 7 § 1808. Magisterial district judges. 8 A magisterial district judge shall receive an annual salary 9 equal to 50% of the annual salary determined under section 10 1805(a) (relating to courts of common pleas). 11 § 1809. Senior judges. 12 (a) Amount.--The compensation payable to a senior judge of a 13 court of common pleas, a senior Commonwealth Court judge, a 14 senior Superior Court judge and a senior Supreme Court justice, 15 assigned pursuant to section 4121 (relating to assignment of 16 judges) and a senior Philadelphia Municipal Court judge assigned 17 pursuant to section 4124 (relating to assignment of senior 18 Philadelphia Municipal Court judges) shall be $456 per day plus 19 all adjustments under section 1810(a)(1)(ii) (relating to cost 20 of living). In any calendar year the amount of compensation 21 which a senior judge shall be permitted to earn as a senior 22 judge shall not, when added to retirement income paid by the 23 Commonwealth, for the senior judge, exceed the annual salary 24 payable by the Commonwealth to a judge then in regular active 25 service on the court from which the senior judge retired. 26 (b) Limitation.--In any calendar year, the amount of 27 compensation which a senior judge assigned to serve on a court 28 referred to in section 1806 (relating to Philadelphia Municipal 29 Court), 1807 (relating to Philadelphia Traffic Court) or 1808 30 (relating to magisterial district judges) shall be permitted to 20050H1521B2570 - 6 -
1 earn as a senior judge shall not, when added to retirement 2 income paid by the Commonwealth to that senior judge, exceed the 3 compensation payable by the Commonwealth to a judge then in 4 regular active service on the court from which that senior judge 5 retired. 6 (c) Volunteer service.--A senior judge who so elects may 7 serve without being paid all or any portion of the compensation 8 provided by this section. 9 § 1809.1. District attorneys. 10 Notwithstanding section 1401(g) of the act of August 9, 1955 11 (P.L.323, No.130), known as The County Code, the salary of a 12 district attorney and a part-time district attorney shall be 13 determined as follows: 14 (1) The salary of a full-time district attorney shall be 15 95% of the salary of a judge of the court of common pleas 16 under section 1805(a) (relating to court of common pleas). 17 (2) The salary of a part-time district attorney shall be 18 determined as follows: 19 (i) Counties of the third or fourth class shall be 20 60% of the salary under paragraph (1). 21 (ii) Counties of the fifth or sixth class shall be 22 50% of the salary under paragraph (1). 23 (iii) Counties of the seventh or eighth class shall 24 be 40% of the salary under paragraph (1). 25 § 1810. Cost of living. 26 (a) Increase.--Beginning January 1, 2007, and each January 1 27 thereafter, the current annual salaries under this chapter shall 28 be increased as follows: 29 (1) Except as set forth in paragraph (2), by the greater 30 of: 20050H1521B2570 - 7 -
1 (i) the percentage increase in the salary of the 2 applicable designated Federal official during the 3 immediately preceding period from December 1 through 4 November 30; or 5 (ii) the percentage increase in the Consumer Price 6 Index for All Urban Consumers (CPI-U) for the 7 Pennsylvania, New Jersey, Delaware and Maryland area for 8 the most recent 12-month period for which figures have 9 been officially reported by the United States Department 10 of Labor, Bureau of Labor Statistics. 11 (2) If the salary of the applicable designated Federal 12 official has been increased in the previous 12-month period, 13 after not having been increased in one or more previous 14 consecutive 12-month periods, the current annual salaries 15 under this chapter shall be increased by the greater of: 16 (i) the percentage change in the Consumer Price 17 Index for all Urban Consumers (CPI-U) for the 18 Pennsylvania, New Jersey, Delaware and Maryland area for 19 the most recent 12-month period for which figures have 20 been officially reported by the United States Department 21 of Labor, Bureau of Labor Statistics; or 22 (ii) the excess of the percentage of the increase in 23 the salary of the applicable designated Federal official 24 over the cumulative percentage increase of the change in 25 the Consumer Price Index for all Urban Consumers (CPI-U) 26 for the Pennsylvania, New Jersey, Delaware and Maryland 27 area for the same period of time between the most current 28 increase in the salary of the applicable designated 29 Federal official and the immediate prior increase. 30 (b) Administration.--The annual salaries as adjusted under 20050H1521B2570 - 8 -
1 subsection (a) shall be published in the Pennsylvania Bulletin 2 by the Court Administrator of Pennsylvania by January 1, 2007, 3 and by each January 1 thereafter. 4 Section 2. Title 46 is amended by adding a part to read: 5 PART II 6 MEMBERS OF THE GENERAL ASSEMBLY 7 Chapter 8 11. Compensation 9 13. Officers and Leaders 10 CHAPTER 11 11 COMPENSATION 12 Sec. 13 1101. Definitions. 14 1102. Members of the General Assembly. 15 1103. Legislative officers and leaders. 16 1104. Cost of living. 17 1105. Payment of salaries. 18 1106. Mileage and expenses. 19 1107. Additional expenses. 20 § 1101. Definitions. 21 The following words and phrases when used in this chapter 22 shall have the meanings given to them in this section unless the 23 context clearly indicates otherwise: 24 "Base salary." The salary for the designated Federal 25 official as of January 1, 2005. 26 § 1102. Members of the General Assembly. 27 (a) Senate.--Except as set forth in section 1103(a) 28 (relating to legislative officers and leaders), a member of the 29 Senate shall receive an annual salary equal to 50% of the base 30 salary of a member of the United States House of Representatives 20050H1521B2570 - 9 -
1 plus all adjustments under section 1104 (relating to cost of 2 living). 3 (b) House of Representatives.--Except as set forth in 4 section 1103(b), a member of the House of Representatives shall 5 receive an annual salary equal to 50% of the base salary of a 6 member of the United States House of Representatives plus all 7 adjustments under section 1104. 8 § 1103. Legislative officers and leaders. 9 (a) Senate.--Annual salaries for legislative officers and 10 leaders of the Senate are as follows: 11 (1) Except as set forth in paragraph (5)(i), a committee 12 chairman shall receive 55% of the base salary of a member of 13 the United States House of Representatives plus all 14 adjustments under section 1104 (relating to cost of living). 15 (2) A committee vice chairman shall receive 52.5% of the 16 base salary of a member of the United States House of 17 Representatives plus all adjustments under section 1104. 18 (3) The following shall receive the salary determined 19 under paragraph (1) plus 20% of that salary: 20 (i) Caucus Administrator. 21 (ii) Caucus Secretary. 22 (iii) Caucus Policy Chairman. 23 (iv) Deputy Whip. 24 (4) The Caucus Chairman shall receive the salary 25 determined under paragraph (3) plus 8% of that salary. 26 (5) The following shall receive the salary determined 27 under paragraph (4) plus 8% of that salary: 28 (i) Appropriations Chairman. 29 (ii) Whip. 30 (6) A Floor Leader shall receive the salary determined 20050H1521B2570 - 10 -
1 under paragraph (5) plus 8% of that salary. 2 (7) The President pro tempore of the Senate shall 3 receive the salary determined under paragraph (6) plus 8% of 4 that salary. 5 (b) House of Representatives.--Annual salaries for 6 legislative officers and leaders of the House of Representatives 7 are as follows: 8 (1) Except as set forth in paragraph (5)(i), a committee 9 chairman shall receive 55% of the base salary of a member of 10 the United States House of Representatives plus all 11 adjustments under section 1104. 12 (2) A committee vice chairman and a subcommittee 13 chairman shall receive 52.5% of the base salary of a member 14 of the United States House of Representatives plus all 15 adjustments under section 1104. 16 (3) The following shall receive the salary determined 17 under paragraph (1) plus 20% of that salary: 18 (i) Caucus Administrator. 19 (ii) Caucus Secretary. 20 (iii) Caucus Policy Chairman. 21 (4) The Caucus Chairman shall receive the salary 22 determined under paragraph (3) plus 8% of that salary. 23 (5) The following shall receive the salary determined 24 under paragraph (4) plus 8% of that salary: 25 (i) Appropriations Chairman. 26 (ii) Whip. 27 (6) A Floor Leader shall receive the salary determined 28 under paragraph (5) plus 8% of that salary. 29 (7) The Speaker of the House of Representatives shall 30 receive the salary determined under paragraph (6) plus 8% of 20050H1521B2570 - 11 -
1 that salary. 2 (c) Limitations.-- 3 (1) An individual entitled to receive an annual salary 4 under this section shall be ineligible to concurrently 5 receive an annual salary under section 1102 (relating to 6 members of the General Assembly). 7 (2) An individual shall be ineligible to concurrently 8 receive more than one annual salary under this section. 9 (3) An individual entitled to receive an annual salary 10 under subsection (a)(3), (4), (5), (6) or (7) shall be 11 ineligible to concurrently receive an annual salary under 12 subsection (a)(1) or (2). 13 (4) An individual entitled to receive an annual salary 14 under subsection (b)(3), (4), (5), (6) or (7) shall be 15 ineligible to concurrently receive an annual salary under 16 subsection (b)(1) or (2). 17 (d) Officers and chairmen.-- 18 (1) Except as set forth in paragraph (2), if an 19 individual receives an annual salary increase under this 20 section, the salary increase shall take effect as of the date 21 the individual is selected or elected. 22 (2) For an individual who is selected or elected in the 23 first two months of an odd-numbered year, if the individual 24 receives an annual salary increase under this section, the 25 salary increase shall be retroactive to December 1 of the 26 preceding even-numbered year. 27 § 1104. Cost of living. 28 (a) Formula.--On December 1, 2006, and each December 1 29 thereafter, the current annual salaries under sections 1102 30 (relating to members of the General Assembly) and 1103(a)(1) and 20050H1521B2570 - 12 -
1 (2) and (b)(1) and (2) (relating to legislative officers and 2 leaders) shall be increased as follows: 3 (1) Except as set forth in paragraph (2), by the greater 4 of: 5 (i) the percentage increase in the salary of the 6 applicable designated Federal official during the 7 immediately preceding period from December 1 through 8 November 30; or 9 (ii) the percentage change in the Consumer Price 10 Index for All Urban Consumers (CPI-U) for the 11 Pennsylvania, New Jersey, Delaware and Maryland area, for 12 the most recent 12-month period for which figures have 13 been officially reported by the United States Department 14 of Labor, Bureau of Labor Statistics. 15 (2) If the salary of the applicable designated Federal 16 official has been increased in the previous 12-month period, 17 after not having been increased in one or more previous 18 consecutive 12-month periods, the current annual salaries 19 under sections 1102 and 1103(a)(1) and (2) and (b)(1) and (2) 20 shall be increased by the greater of: 21 (i) the percentage change in the Consumer Price 22 Index for all Urban Consumers (CPI-U) for the 23 Pennsylvania, New Jersey, Delaware and Maryland area for 24 the most recent 12-month period for which figures have 25 been officially reported by the United States Department 26 of Labor, Bureau of Labor Statistics; or 27 (ii) the excess of the percentage of the increase in 28 the salary of the applicable designated Federal official 29 over the cumulative percentage increase of the change in 30 the Consumer Price Index for all Urban Consumers (CPI-U) 20050H1521B2570 - 13 -
1 for the Pennsylvania, New Jersey, Delaware and Maryland 2 area for the same period of time between the most current 3 increase in the salary of the applicable designated 4 Federal official and the immediate prior increase. 5 (b) Administration.--The annual salaries determined jointly 6 by the Chief Clerk of the Senate and the Chief Clerk of the 7 House of Representatives under subsection (a) shall be published 8 in the Pennsylvania Bulletin by December 1, 2006, and by each 9 December 1 thereafter. 10 § 1105. Payment of salaries. 11 The annual salary of a member of the General Assembly shall 12 be payable in equal monthly installments the first day of the 13 month, including the installment due December 1 of each even- 14 numbered year. 15 § 1106. Mileage and expenses. 16 (a) Mileage.--A member of the General Assembly shall be 17 reimbursed for mileage, circular, between the member's home and 18 the State Capitol for each week the member was in actual 19 attendance in session. The rate of reimbursement shall be set by 20 the Committee on Management Operations for members of the Senate 21 and by the Bipartisan Management Committee for members of the 22 House of Representatives. The rate shall not exceed the Standard 23 Business Mileage Rate set by the Internal Revenue Service. 24 (b) Expenses.--Each member of the General Assembly shall 25 receive an allocation for clerical assistance and other actual 26 expenses incurred during the member's term in connection with 27 the duties of the member's office in the sum of $7,500 annually. 28 § 1107. Additional expenses. 29 (a) Senate.-- 30 (1) Beginning on the effective date of this subsection, 20050H1521B2570 - 14 -
1 and ending November 30, 2008, a member of the Senate shall 2 receive monthly, in addition to any allocation for clerical 3 assistance and other actual expenses, an unvouchered expense 4 allocation in the amount of 1/12 of the difference between: 5 (i) the amount specified for a member in: 6 (A) section 1102(a) (relating to members of the 7 General Assembly) plus section 1104 (relating to cost 8 of living) as appropriate; or 9 (B) section 1103(a) (relating to legislative 10 officers and leaders) plus section 1104 as 11 appropriate; and 12 (ii) the amount calculated for that member as of the 13 effective date of this subparagraph pursuant to the act 14 of September 30, 1983 (P.L.160, No.39), known as the 15 Public Official Compensation Law. 16 (2) This subsection shall expire November 30, 2008. 17 (b) House of Representatives.-- 18 (1) Beginning on the effective date of this subsection, 19 a member of the House of Representatives may receive each 20 month, in addition to any allocation for clerical assistance 21 and other actual expenses, an unvouchered expense allocation 22 in the amount of 1/12 of the difference between: 23 (i) the amount specified for a member in: 24 (A) section 1102(b); or 25 (B) section 1103(b) as appropriate; and 26 (ii) the amount calculated for that member as of the 27 effective date of this subparagraph pursuant to the 28 Public Official Compensation Law. 29 (2) The Rules Committee of the House of Representatives 30 shall determine the procedure by which a member of the House 20050H1521B2570 - 15 -
1 of Representatives may receive an allocation under this 2 subsection. 3 (3) This subsection shall expire November 30, 2006. 4 CHAPTER 13 5 OFFICERS AND LEADERS 6 Sec. 7 1301. Senate. 8 1302. House of Representatives. 9 § 1301. Senate. 10 (a) Election.-- 11 (1) The President pro tempore of the Senate shall be 12 elected by the members of the Senate. 13 (2) The following officers of the Senate shall be 14 elected by the appropriate caucus: 15 (i) Majority Leader. 16 (ii) Minority Leader. 17 (iii) Majority Whip. 18 (iv) Minority Whip. 19 (v) Majority Caucus Chairman. 20 (vi) Minority Caucus Chairman. 21 (vii) Appropriations Chairman. 22 (viii) Minority Appropriations Chairman. 23 (ix) Majority Caucus Secretary. 24 (x) Minority Caucus Secretary. 25 (xi) Minority Policy Chairman. 26 (b) Appointment.-- 27 (1) The following officers of the Senate shall be 28 appointed by the President pro tempore of the Senate: 29 (i) Majority Policy Chairman. 30 (ii) Majority Caucus Administrator. 20050H1521B2570 - 16 -
1 (iii) Majority Deputy Whip. 2 (2) The following officers of the Senate shall be 3 appointed by the Minority Leader of the Senate: 4 (i) Minority Caucus Administrator. 5 (ii) Minority Deputy Whip. 6 § 1302. House of Representatives. 7 (a) Members.--The Speaker of the House of Representatives 8 shall be elected by the members of the House of Representatives. 9 (b) Caucuses.--The following officers of the House of 10 Representatives shall be elected by the appropriate caucus: 11 (1) Majority Leader. 12 (2) Minority Leader. 13 (3) Majority Whip. 14 (4) Minority Whip. 15 (5) Majority Caucus Chairman. 16 (6) Minority Caucus Chairman. 17 (7) Appropriations Chairman. 18 (8) Minority Appropriations Chairman. 19 (9) Majority Caucus Secretary. 20 (10) Minority Caucus Secretary. 21 (11) Majority Policy Chairman. 22 (12) Minority Policy Chairman. 23 (13) Majority Caucus Administrator. 24 (14) Minority Caucus Administrator. 25 Section 3. 1 COMPENSATION 2 Sec. 3 1101. Definitions. 4 1102. Governor, Lieutenant Governor and Cabinet. 5 1103. State Treasurer, Auditor General and Attorney General. 6 1104. Additional salary prohibited. 7 1105. Cost of living. 8 § 1101. Definitions. 9 The following words and phrases when used in this chapter 10 shall have the meanings given to them in this section unless the 11 context clearly indicates otherwise: 12 "Base salary." The salary for the designated Federal 13 official as of January 1, 2007. 14 § 1102. Governor, Lieutenant Governor and Cabinet. 15 (a) Governor.--The Governor shall receive an annual salary 16 equal to 85% of the base salary of the Vice President of the 17 United States plus all adjustments under section 1105 (relating 18 to cost of living). 19 (b) Lieutenant Governor.--The Lieutenant Governor shall 20 receive an annual salary equal to: 21 (1) the salary under 46 Pa.C.S. § 1103(a)(7) (relating 22 to legislative officers and leaders); plus 23 (2) $15,000. 24 (c) Cabinet.--Each of the following officers shall receive 25 an annual salary equal to 85% of the base salary of the Attorney 26 General of the United States plus all adjustments under section 27 1105: 28 (1) Adjutant General. 29 (2) Secretary of Aging. 30 (3) Secretary of Agriculture. 20050H1521B2570 - 18 -
1 (4) Secretary of Banking. 2 (5) Secretary of the Commonwealth. 3 (6) Secretary of Community and Economic Development. 4 (7) Secretary of Conservation and Natural Resources. 5 (8) Secretary of Corrections. 6 (9) Secretary of Education. 7 (10) Secretary of Environmental Protection. 8 (11) Secretary of General Services. 9 (12) Secretary of Health. 10 (13) Insurance Commissioner of the Commonwealth. 11 (14) Secretary of Labor and Industry. 12 (15) Secretary of Public Welfare. 13 (16) Secretary of Revenue. 14 (17) Pennsylvania State Police Commissioner. 15 (18) Secretary of Transportation. 16 § 1103. State Treasurer, Auditor General and Attorney General. 17 Each of the following officers shall receive an annual salary 18 equal to 94% of the base salary of the Attorney General of the 19 United States plus all adjustments under section 1105 (relating 20 to cost of living): 21 (1) State Treasurer. 22 (2) Attorney General. 23 (3) Auditor General. 24 § 1104. Additional salary prohibited. 25 No officer listed in this chapter shall receive additional 26 salary for services rendered to the Commonwealth in any 27 capacity. 28 § 1105. 1 and (c) (relating to Governor, Lieutenant Governor and Cabinet) 2 and 1103 (relating to State Treasurer, Auditor General and 3 Attorney General) shall be increased as follows: 4 (1) Except as set forth in paragraph (2), by the greater 5 of: 6 (i) the percentage increase in the salary of the 7 applicable designated Federal official during the 8 immediately preceding period from December 1 through 9 November 30; or 10 (ii) the percentage increase in the Consumer Price 11 Index for All Urban Consumers (CPI-U) for the 12 Pennsylvania, New Jersey, Delaware and Maryland area, for 13 the most recent 12-month period for which figures have 14 been officially reported by the United States Department 15 of Labor, Bureau of Labor Statistics. 16 (2) If the salary of the applicable designated Federal 17 official has been increased in the previous 12-month period, 18 after not having been increased in one or more previous 19 consecutive 12-month periods, the current annual salaries 20 under sections 1102(a) and (c) and 1103 shall be increased by 21 the greater of: 22 (i) the percentage change in the Consumer Price 23 Index for all Urban Consumers (CPI-U) for the 24 Pennsylvania, New Jersey, Delaware and Maryland area for 25 the most recent 12-month period for which figures have 26 been officially reported by the United States Department 27 of Labor, Bureau of Labor Statistics; or 28 (ii) the excess of the percentage of the increase in 29 the salary of the applicable designated Federal official 30 over the cumulative percentage increase of the change in 20050H1521B2570 - 20 -
1 the Consumer Price Index for all Urban Consumers (CPI-U) 2 for the Pennsylvania, New Jersey, Delaware and Maryland 3 area for the same period of time between the most current 4 increase in the salary of the applicable designated 5 Federal official and the immediate prior increase. 6 (b) Administration.--The annual salaries as adjusted under 7 subsection (a) shall be published by the Secretary of the Budget 8 in the Pennsylvania Bulletin by January 1, 2008, and by each 9 January 1 thereafter. 10 Section 4. This act shall apply as follows: 11 (1) Except for the application of 46 Pa.C.S. § 1107, the 12 addition of 46 Pa.C.S. §§ 1101 through 1104 and 1106(a) shall 13 apply to members of the General Assembly elected after the 14 effective date of this act. 15 (2) The addition of 46 Pa.C.S. § 1107 shall apply to 16 members of the General Assembly elected prior to the 17 effective date of this act. 18 (3) The addition of 71 Pa.C.S. §§ 1102(c) and 1105 shall 19 apply to individuals who are appointed after December 31, 20 2006. 21 (4) The addition of 71 Pa.C.S. §§ 1102(a) and (b) and 22 1103 shall apply to individuals who are elected after the 23 effective date of this act. 24 (5) For purposes of section 3(d) of the act of September 25 30, 1983 (P.L.160, No.39), known as the Public Official 26 Compensation Law, the salary of the Secretary of Community 27 and Economic Development shall be deemed to be the salary on 28 the day before the effective date of this act. 1 Section 5. The Public Official Compensation Law is repealed 2 insofar as it is inconsistent with this act. 3 Section 6. The provisions of this act are nonseverable. If 4 any provision of this act or its application to any person or 5 circumstance is held invalid, the remaining provisions or 6 applications of this act are void. 7 Section 7.
