AN ACT 1 To provide from the General Fund for the expenses of the 2 Executive, Legislative and Judicial Departments of the 3 Commonwealth, the public debt and for the public schools for 4 the fiscal year July 1, 2005, to June 30, 2006, for certain 5 institutions and organizations, and for the payment of bills 6 incurred and remaining unpaid at the close of the fiscal year 7 ending June 30, 2005; to provide appropriations from the 8 State Lottery Fund, the Energy Conservation and Assistance 9 Fund, the Hazardous Material Response Fund, The State Stores 10 Fund, the Milk Marketing Fund, the Home Investment Trust 11 Fund, the Emergency Medical Services Operating Fund, the 12 Tuition Payment Fund, the Banking Department Fund, the 13 Firearm Records Check Fund, the Ben Franklin Technology 14 Development Authority Fund, the Tobacco Settlement Fund, the 15 Health Care Provider Retention Account and the Alternative 16 Fuels Incentive Grant Fund to the Executive Department; to 17 provide appropriations from the Judicial Computer System 18 Augmentation Account to the Judicial Department for the 19 fiscal year July 1, 2005, to June 30, 2006; to provide 20 appropriations from the Motor License Fund for the fiscal 21 year July 1, 2005, to June 30, 2006, for the proper operation 22 of the several departments of the Commonwealth and the 23 Pennsylvania State Police authorized to spend Motor License 24 Fund moneys; to provide for the appropriation of Federal 25 funds to the Executive Department of the Commonwealth and for 26 the establishment of restricted receipt accounts for the 27 fiscal year July 1, 2005, to June 30, 2006, and for the 28 payment of bills remaining unpaid at the close of the fiscal 29 year ending June 30, 2005; to provide for the additional 30 appropriation of Federal and State funds from the General 31 Fund, for the Executive and the Legislative Departments of 32 the Commonwealth for the fiscal year July 1, 2004, to June 33 30, 2005, and for the payment of bills incurred and remaining

Effective date. 14 The General Assembly of the Commonwealth of Pennsylvania 15 hereby enacts as follows: 16 PART I 17 GENERAL PROVISIONS 18 Section 101. Short title.--This act shall be known and may 19 be cited as the General Appropriation Act of 2005. 20 Section 102. Definitions.--The following words and phrases 21 when used in this act shall have the meanings given to them in 22 this section unless the context clearly indicates otherwise: 23 "Employees." Includes all directors, superintendents, bureau 24 or division chiefs, assistant directors, assistant 25 superintendents, assistant chiefs, experts, scientists, 26 engineers, surveyors, draftsmen, accountants, secretaries, 27 auditors, inspectors, examiners, analysts, statisticians, 28 marshals, clerks, stenographers, bookkeepers, messengers and 29 other assistants in any department, board or commission. 30 "Expenses" and "maintenance." 1 and stationery, food and forage, materials and supplies, 2 traveling expenses, training, motor vehicle supplies and 3 repairs, freight, express and cartage, postage, telephones and 4 telegraph rentals and toll charges, newspaper advertising and 5 notices, public advertising by or through any medium, fuel, 6 light, heat, power and water, minor construction and renovation, 7 repairs or reconstruction of equipment, buildings and 8 facilities, rent of real estate and equipment, premiums on 9 workers' compensation, insurance premiums on policies of 10 liability insurance, insurance premiums on medical payment 11 insurance and surety bonds for volunteer workers, premiums on 12 employee group life insurance and employee and retired employee 13 group hospital and medical insurance, payment of Commonwealth 14 share of Social Security taxes and unemployment compensation 15 costs for State employees, the purchase of replacement or 16 additional equipment and machinery and all other incidental 17 costs and expenses, including payment to the Department of 18 General Services of mileage and other charges for the use of 19 automobiles and rental payments for permanently assigned 20 automobiles and of expenses or costs of services incurred 21 through the Purchasing Fund. The term "expenses" also shall 22 include the medical costs for the treatment of inmates of State 23 institutions when the inmate must be transferred to an outside 24 hospital: Provided, That in no case shall the State institution 25 pay more for patient care than that provided under the State 26 medical assistance program. 27 Section 103. Abbreviations.--The following abbreviations 28 when used in this act shall have the meanings given to them in 29 this section unless the context clearly indicates otherwise: 30 "ARC." 1 following sums set forth in this act, or as much thereof as may 2 be necessary, are hereby specifically appropriated from the 3 General Fund to the several hereinafter named agencies of the 4 Executive, Legislative and Judicial Departments of the 5 Commonwealth for the payment of salaries, wages or other 6 compensation and travel expenses of the duly elected or 7 appointed officers and employees of the Commonwealth, for the 8 payment of fees for contractual services rendered, for the 9 purchase or rental of goods and services, printing, public 10 advertising by or through any medium, equipment, land and 11 buildings and for payment of any other expenses, as provided by 12 law or by this act, necessary for the proper conduct of the 13 duties, functions and activities and for the purposes 14 hereinafter set forth for the fiscal year beginning July 1, 15 2005, and for the payment of bills incurred and remaining unpaid 16 at the close of the fiscal year ending June 30, 2005. 17 (b) State Lottery Fund.--The following sums set forth in 18 this act, or as much thereof as may be necessary, are hereby 19 specifically appropriated from the State Lottery Fund to the 20 several hereinafter named agencies of the Executive Department 21 of the Commonwealth for the payment of salaries, wages or other 22 compensation and travel expenses of the duly appointed officers 23 and employees of the Commonwealth, for the payment of fees for 24 contractual services rendered, for the purchase or rental of 25 goods and services and for payment of any other expenses, as 26 provided by law or by this act, necessary for the proper conduct 27 of the duties, functions and activities and for the purposes 28 hereinafter set forth for the fiscal year beginning July 1, 29 2005, and for the payment of bills incurred and remaining unpaid 30 at the close of the fiscal year ending June 30, 2005. 20050H0815B0848 - 11 -
1 (c) Energy Conservation and Assistance Fund.--The following 2 sums set forth in this act, or as much thereof as may be 3 necessary, are hereby specifically appropriated from the Energy 4 Conservation and Assistance Fund to the several hereinafter 5 named agencies of the Executive Department of the Commonwealth 6 for the payment of fees for contractual services rendered, for 7 the purchase or rental of goods and services and for the payment 8 of any other expenses, as provided by law or by this act, 9 necessary for the proper conduct of the duties, functions and 10 activities and for the purposes hereinafter set forth for the 11 fiscal year beginning July 1, 2005, and for the payment of bills 12 incurred and remaining unpaid at the close of the fiscal year 13 ending June 30, 2005. 14 (d) Judicial Computer System Augmentation Account.--The 15 following sums set forth in this act, or as much thereof as may 16 be necessary, are hereby specifically appropriated from the 17 restricted receipt account established within the General Fund, 18 known as the Judicial Computer System Augmentation Account, to 19 the Judicial Department of the Commonwealth for the payment of 20 salaries, wages or other compensation and travel expenses, for 21 the payment of fees for contractual services rendered, for the 22 purchase or rental of goods and services and for the payment of 23 any other expenses, as provided by law or by this act, necessary 24 for the proper conduct of the duties, functions and activities 25 and for the purposes hereinafter set forth for the fiscal year 26 beginning July 1, 2005, and for the payment of bills incurred 27 and remaining unpaid at the close of the fiscal year ending June 28 30, 2005. 29 (e) Emergency Medical Services Operating Fund.--The 30 following sums set forth in this act, or as much thereof as may 20050H0815B0848 - 12 -
1 be necessary, are hereby specifically appropriated from the 2 Emergency Medical Services Operating Fund to the several 3 hereinafter named agencies of the Executive Department of the 4 Commonwealth for the payment of fees for contractual services 5 rendered, for the purchase or rental of goods and services and 6 for the payment of any other expenses, as provided by law or by 7 this act, necessary for the proper conduct of the duties, 8 functions and activities and for the purposes hereinafter set 9 forth for the fiscal year beginning July 1, 2005, and for the 10 payment of bills incurred and remaining unpaid at the close of 11 the fiscal year ending June 30, 2005. 12 (f) The State Stores Fund.--The following sums set forth in 13 this act, or as much thereof as may be necessary, are hereby 14 specifically appropriated from The State Stores Fund to the 15 hereinafter named agency of the Executive Department of the 16 Commonwealth for the payment of salaries, wages or other 17 compensation and travel expenses of the duly appointed officers 18 and employees of the Commonwealth, for the payment of fees for 19 contractual services rendered, for the purchase or rental of 20 goods and services and for the payment of any other expenses, as 21 provided by law or by this act, necessary for the proper conduct 22 of the duties, functions and activities and for the purposes 23 hereinafter set forth for the fiscal year beginning July 1, 24 2005, and for the payment of bills incurred and remaining unpaid 25 at the close of the fiscal year ending June 30, 2005. 26 (g) Motor License Fund.--The following sums, or as much 27 thereof as may be necessary, are hereby appropriated from the 28 Motor License Fund to the hereinafter named agencies of the 29 Executive Department for the payment of salaries, wages and 30 other compensation and travel expenses of the duly elected or 20050H0815B0848 - 13 -
1 appointed officers and employees of the Commonwealth, for 2 contractual services and other expenses necessary for the proper 3 conduct of the duties, functions and activities for the purposes 4 hereinafter set forth for the fiscal year beginning July 1, 5 2005, and for the payment of bills incurred and remaining unpaid 6 at the close of the fiscal year ending June 30, 2005. 7 (h) Aviation Restricted Revenue Account.--The following 8 sums, or as much thereof as may be necessary, are hereby 9 appropriated from the Aviation Restricted Revenue Account in the 10 Motor License Fund to the hereinafter named agencies of the 11 Executive Department for the purposes set forth herein for the 12 fiscal year beginning July 1, 2005, and for the payment of bills 13 incurred and remaining unpaid at the close of the fiscal year 14 ending June 30, 2005. 15 (i) Hazardous Material Response Fund.--The following sums 16 set forth in this act, or as much thereof as may be necessary, 17 are hereby specifically appropriated from the Hazardous Material 18 Response Fund to the several hereinafter named agencies of the 19 Executive Department of the Commonwealth for the payment of fees 20 for contractual services rendered, for the purchase or rental of 21 goods and services and for the payment of any other expenses, as 22 provided by law or by this act, necessary for the proper conduct 23 of the duties, functions and activities and for the purposes 24 hereinafter set forth for the fiscal year beginning July 1, 25 2005, and for the payment of bills incurred and remaining unpaid 26 at the close of the fiscal year ending June 30, 2005. 27 (j) Milk Marketing Fund.--The following sums set forth in 28 this act, or as much thereof as may be necessary, are hereby 29 specifically appropriated from the Milk Marketing Fund to the 30 several hereinafter named agencies of the Executive Department 20050H0815B0848 - 14 -
1 of the Commonwealth for the payment of salaries, wages or other 2 compensation and travel expenses of the duly appointed officers 3 and employees of the Commonwealth, for the payment of fees for 4 contractual services rendered, for the purchase or rental of 5 goods and services and for the payment of any other expenses, as 6 provided by law or by this act, necessary for the proper conduct 7 of the duties, functions and activities and for the purposes 8 hereinafter set forth for the fiscal year beginning July 1, 9 2005, and for the payment of bills incurred and remaining unpaid 10 at the close of the fiscal year ending June 30, 2005. 11 (k) Home Investment Trust Fund.--The following sums set 12 forth in this act, or as much thereof as may be necessary, are 13 hereby specifically appropriated from the Home Investment Trust 14 Fund to the hereinafter named agencies of the Executive 15 Department of the Commonwealth for the payment of salaries, 16 wages or other compensation and travel expenses of the duly 17 appointed officers and employees of the Commonwealth, for the 18 payment of fees for contractual services rendered, for the 19 purchase or rental of goods and services and for the payment of 20 any other expenses, as provided by law or by this act, necessary 21 for the proper conduct of the duties, functions and activities 22 and for the purposes hereinafter set forth for the fiscal year 23 beginning July 1, 2005, and for the payment of bills incurred 24 and remaining unpaid at the close of the fiscal year ending June 25 30, 2005. 26 (l) Tuition Payment Fund.--The following sums set forth in 27 this act, or as much thereof as may be necessary, are hereby 28 specifically appropriated from the Tuition Payment Fund to the 29 hereinafter named agencies of the Executive Department of the 30 Commonwealth for the payment of salaries, wages or other 20050H0815B0848 - 15 -

1 block grant (BG) funds to the several hereinafter named agencies 2 of the Executive Department of the Commonwealth for the 3 purposes, and under the restrictions, for which the funds are 4 provided for the fiscal year beginning July 1, 2005. 5 (b) Small Communities Development Block Grant.--The Small 6 Communities Development Block Grant (SCDBG) is to assist small 7 cities and communities that have a high concentration of 8 impoverished citizens and substandard housing to expand their 9 low-income and moderate-income housing opportunities and to meet 10 community development needs. 11 (c) Community Services Block Grant.--The Community Services 12 Block Grant (CSBG) is to provide a range of services and 13 activities having a measurable and potentially major impact on 14 the causes of poverty in the community or those areas of the 15 community where poverty is a particularly acute problem. In 16 addition, new focus may be placed on the unemployed, both old 17 and new. Local agencies may lower their eligibility requirements 18 for recipients to three months to allow greater flexibility to 19 assure proper consideration of each recipient. 20 (d) Preventive Health and Health Services Block Grant.--The 21 Preventive Health and Health Services Block Grant (PHHSBG) is 22 for the provision of preventive health and other health services 23 related to emergency medical systems, health initiative grants, 24 comprehensive public health, hypertension, fluoridation, health 25 education, risk reduction, home health, rape crisis and domestic 26 violence services. 27 (e) Maternal and Child Health Services Block Grant.--The 28 Maternal and Child Health Services Block Grant (MCHSBG) is to 29 enable states to maintain and strengthen their leadership in 30 planning, promoting, coordinating and evaluating health care for 20050H0815B0848 - 19 -
1 pregnant women, mothers, infants and children, and children with 2 special health care needs, and in providing health services for 3 mothers and children who do not have access to adequate health 4 care. 5 (f) Low-Income Home Energy Assistance Block Grant.--The Low- 6 Income Home Energy Assistance Block Grant (LIHEABG) is to help 7 lessen the impact of the high cost of energy on low-income 8 families and individuals, including energy efficiency grants for 9 low-income dwellings. No less than 15% of the LIHEABG funds 10 received shall be used for weatherization. LIHEABG funds 11 received pursuant to a Presidential release of contingency funds 12 shall be exempt from the 15% requirement. Unexpended 13 weatherization funds which would result in LIHEABG funds being 14 returned to the Federal Department of Health and Human Services 15 may be spent for assistance grants at the discretion of the 16 Secretary of the Budget. The Secretary of the Budget shall 17 notify the chairman and the minority chairman of the 18 Appropriations Committee of the Senate and the chairman and the 19 minority chairman of the Appropriations Committee of the House 20 of Representatives of the intent to reallocate any such funds 21 ten days prior to any reallocation. 22 (g) Social Services Block Grant.--The Social Services Block 23 Grant (SSBG) is for the provision of social services to eligible 24 persons. 25 (h) Mental Health Services Block Grant.--The Mental Health 26 Services Block Grant (MHSBG) provides funds for the provision of 27 services to adults with serious mental illness or children with 28 serious emotional disturbance. 29 (i) Substance Abuse Block Grant.--The Substance Abuse Block 30 Grant (SABG) provides funds to establish and maintain programs 20050H0815B0848 - 20 -

Compliance with other law before funds 23 available.--No appropriation made by this part to any 24 department, board, commission or agency of the Executive 25 Department shall be available unless and until the department, 26 board, commission or agency has complied with sections 615 and 27 616 of the act of April 9, 1929 (P.L.177, No.175), known as The 28 Administrative Code of 1929. 29 Section 1893. Minority business set-asides.--(a) Each 5 department or other instrumentality of the Commonwealth listed 6 in Subpart B authorized to contract for buildings, highways, 7 commodities, equipment, supplies or services shall report to the 8 General Assembly all information pertinent to anticipated 9 procurement needs at the beginning of each fiscal year and each 10 fiscal quarter thereafter. 11 (b) As used in this section, the term "minority business" 12 means a minority business enterprise as defined in the act of 13 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania 14 Minority Business Development Authority Act. 15 Section 1895. Appropriation of funds from miscellaneous 16 sources.--(a) In addition to the amounts appropriated by this 17 part, moneys received in payment for food and household supplies 18 furnished to employees and other persons, except inmates, by an 19 institution, and moneys received from the proceeds from the sale 20 of any products of the soil, meats, livestock, timber or other 21 materials sold by the department shall be paid into the General 22 Fund and are hereby appropriated out of the General Fund to the 23 several respective institutions for the operation and 24 maintenance of the institutions. 25 (b) In addition to the amounts appropriated by this part, 26 all moneys received from any other source, except the Federal 27 Government, as contributions for the programs provided herein or 28 as payment for services or materials furnished by one 29 institution to another, except those collections designated as 30 revenues, shall be paid into the General Fund and are hereby 20050H0815B0848 - 209 -
1 appropriated out of the General Fund for the purposes of the 2 respective appropriations. 3 (c) In addition to any funds specifically appropriated by 4 this part, all moneys received by a department or agency of the 5 Commonwealth from any other sources, except the Federal 6 Government, as contributions or supplements to the department or 7 agency for a program or administration of an act included in 8 this part shall be paid into the General Fund and credited to 9 the appropriation for that program or administration of the act. 10 Section 1896. Lapsing of unused funds.--(a) Except as 11 otherwise provided by law or by this section, that part of all 12 appropriations in Part XVIII uncommitted or unencumbered as of 13 June 30, 2005, shall automatically lapse as of that date. 14 (b) The appropriations in Part XVIII to the Pennsylvania 15 Emergency Management Agency for September 1999 Tropical Storm 16 Disaster - Hazard Mitigation and September 2004 Tropical Storm 17 Ivan - Public Assistance shall be continuing appropriations 18 until June 30, 2008. 19 Section 1897. Construction with prior appropriation acts.-- 20 Any appropriation in Subpart B of this part which is the same or 21 similar to any appropriation in the act of July 4, 2004 (P.L. 22 , No.7A), known as the General Appropriation Act of 2004, shall 23 replace that appropriation. 24 Section 1898. Deduction of expended appropriations under 25 prior law.--Any money which has been appropriated and expended 26 under the act of July 4, 2004 (P.L. , No.7A), known as the 27 General Appropriation Act of 2004, shall be deducted from the 28 corresponding appropriation in this part. 29 PART XIX 30 SPECIAL PROVISIONS FOR FEDERAL FUNDS 20050H0815B0848 - 210 -
1 FOR 2005-2006 2 Section 1901. General Fund repository for Federal funds.-- 3 All moneys received from the Federal Government as contributions 4 or supplements to the departments or agencies of the 5 Commonwealth or the programs herein provided shall be paid into 6 the General Fund. 7 Section 1902. Limitation on encumbering or spending Federal 8 funds.--Federal funds shall be encumbered or spent only to the 9 extent that such funds are estimated as being available during 10 the fiscal year of the Commonwealth. 11 Section 1903. Appropriation of prior unspent Federal 12 funds.--Any Federal money which has been previously appropriated 13 by the General Assembly and authorized or allocated by the 14 Federal Government but remains unspent from prior fiscal years 15 and will not be renewed for fiscal year 2005-2006 is hereby 16 appropriated. 17 Section 1904. Subgrants between Federal fund 18 appropriations.--Subgrants may be made between appropriations 19 without further approval of the General Assembly. The Secretary 20 of the Budget shall submit a list of subgrants to the chairman 21 and minority chairman of the Appropriations Committee of the 22 Senate and the chairman and minority chairman of the 23 Appropriations Committee of the House of Representatives 24 quarterly. No subgrant to a State agency, however, may be made 25 from a restricted receipt account without a specific 26 appropriation by the General Assembly. 27 Section 1905. Utilization of emergency Federal funds.--(a) 28 Federal funds available for costs and damages resulting from 29 natural disasters or civil disobedience may be added to an 30 appropriation contained in this act or to funds appropriated or 20050H0815B0848 - 211 -
1 may be used for the purposes prescribed by the Federal 2 Government. 3 (b) In addition to the moneys appropriated by this act, all 4 moneys received from the Federal Government for the purpose of 5 disaster assistance or relief, or other moneys received as a 6 direct result of terrorist acts and moneys for homeland security 7 and defense, shall be paid into the General Fund and are hereby 8 appropriated out of the General Fund to the departments, boards, 9 commissions or agencies designated by the Governor. 10 (c) In the event of any emergency situation in which the 11 General Assembly cannot act in sufficient time, the Governor is 12 authorized through executive authorization to provide up to 13 $10,000,000 in Federal funds to alleviate the emergency 14 situation. For the purposes of this section, "emergency" is 15 defined as any situation in which there is a chance of or which 16 may result in substantial human suffering. 17 Section 1906. Transfer of funds from TANFBG to CCDFBG and 18 SSBG.--In accordance with Federal law which permits the transfer 19 of funds from the TANFBG to the CCDFBG and SSBG, the Department 20 of Public Welfare, upon approval of the Secretary of the Budget, 21 may make such transfers of funds provided that any such transfer 22 will not result in a deficit in any appropriation from which 23 funds are transferred. The Secretary of the Budget shall provide 24 ten days prior notification of any such transfers to the 25 chairman and the minority chairman of the Appropriations 26 Committee of the Senate and the chairman and minority chairman 27 of the Appropriations Committee of the House of Representatives. 28 Section 1907. Transfer of LIHEAP funds.--(a) The Department 29 of Public Welfare, upon approval of the Secretary of the Budget, 30 may transfer up to 15% of any additional funds received for the 20050H0815B0848 - 212 -
1 LIHEAP program either through an increase in the regular program 2 or a Presidential release of contingency funds, to the 3 Department of Community and Economic Development for the LIHEAP 4 - Weatherization Program. The Secretary of the Budget shall 5 provide ten days prior notification of any such transfers to the 6 chairman and minority chairman of the Appropriations Committee 7 of the Senate and the chairman and minority chairman of the 8 Appropriations Committee of the House of Representatives. 9 (b) The Department of Public Welfare, upon approval of the 10 Secretary of the Budget, may transfer LIHEAP administrative 11 funds to the Department of Community and Economic Development 12 subject to any limitations under Federal law. The Secretary of 13 the Budget shall provide ten days prior notification of any such 14 transfer to the chairman and minority chairman of the 15 Appropriations Committee of the Senate and the chairman and 16 minority chairman of the Appropriations Committee of the House 17 of Representatives. 18 PART XX 19 MISCELLANEOUS PROVISIONS FOR 2005-2006 20 Section 2001. Prior laws unaffected.--Except as provided in 21 section 253, this act is not intended to be inconsistent with or 22 to repeal any provision of any act enacted at this or any prior 23 session of the General Assembly regulating the purchase of 24 supplies, the ordering of printing and binding, the purchase, 25 maintenance and use of automobiles, the method of making 26 payments from the State Treasury for any purpose or the 27 functioning of any administrative department, board or 28 commission. 29 Section 2002. Contracts prerequisite to encumbering or 7 committing funds.--Funds available to agencies, boards, 8 departments, commissions, or other governmental entities under 9 this act for the procurement of supplies, services or 10 construction shall not be available for payment of, or to be 11 committed to or encumbered for payment of, any such procurement 12 unless and until the agency, board, department or other 13 governmental entity has complied with all of the requirements 14 applicable to the procurement that are set out in 62 Pa.C.S. 15 (relating to procurement) and in the policies, procedures and 16 regulations instituted in accordance with that code. 17 Section 2004. Lapsing of unused funds.--(a) Except as 24 otherwise provided by law or by this section, that part of all 25 appropriations in Parts II, III, IV, V, VI, VII, VIII, IX, X, 26 XI, XII, XIII, XIV, XV, XVI and XVI-A unexpended, uncommitted or 27 unencumbered as of June 30, 2006, shall automatically lapse as 28 of that date. 29 (b) The appropriation in Part II to the Department of 30 Education for approved private schools and Pennsylvania Charter 20050H0815B0848 - 215 -
1 Schools for the Deaf and Blind for prior years' audit resolution 2 shall be a continuing appropriation until June 30, 2007. 3 (c) The appropriations in Part II to the Pennsylvania 4 Emergency Management Agency for August 2004 Storm Relief, August 5 2004 Storm Disaster-Hazardous Mitigation, August 2004 Storm 6 Disaster-Public Assistance, September 2004 Storm Relief, 7 September 2004 Tropical Storm Ivan-Hazardous Mitigation and 8 September 2004 Tropical Storm Ivan-Public Assistance shall be 9 continuing appropriations until June 30, 2008. 10 (d) The appropriations in Part II to the Legislative 11 Department shall be continuing appropriations. 12 (e) The appropriation in Part VIII to the Pennsylvania 13 Emergency Management Agency for September 2004 Tropical Storm 14 Ivan-Public Assistance shall be a continuing appropriation until 15 June 30, 2008. 16 Section 2007. Appellate courts appropriation contingency.-- 17 The funds appropriated in Part II to the Supreme, Superior and 18 Commonwealth Courts for justice and judge expenses are 19 contingent upon a vouchered expense account plan being continued 20 by the Supreme Court. 21 Section 2008. Transfer of excess funds.--The Governor may 22 transfer any excess money in those funds receiving proceeds of 23 Commonwealth of Pennsylvania general obligation bonds in excess 24 of the amount necessary for the purposes for which the bonds 25 were issued to the appropriate sinking fund for payment of debt 26 service due on outstanding bonds. If such excess funds, together 27 with any available balance, exceed the amount of debt service 28 remaining to be paid, the funds shall be transferred to the 29 General Fund or to the appropriate special fund responsible for 30 such debt service. 20050H0815B0848 - 216 -
1 Section 2009. Transfer of funds by the Supreme Court.--The 2 Supreme Court may transfer during the fiscal year funds 3 appropriated in sections 281, 282, 283, 284, 285, 286, 287, 290 4 and 291 to the Judicial Department in Part II, among any of the 5 line items contained within those sections. No transfer may 6 create or increase a deficiency in the appropriation from which 7 the transfer is made. Whenever the Supreme Court makes a 8 transfer under this section, the Supreme Court shall give 9 written notification to the Secretary of the Budget and chairman 10 and minority chairman of the Senate Committee on Appropriations 11 and the chairman and the minority chairman of the House of 12 Representatives Committee on Appropriations ten days prior to 13 any transfer. The written notice shall also include 14 certification that such transfer will not result in a deficit in 15 any appropriation. This section shall not apply to the 16 appropriation in section 291 for gun courts. 17 PART XXI 18 EFFECTIVE DATE 19 Section 2101. Effective date.--This act shall take effect as 20 follows: 21 (1) Parts XVIII and XXI shall take effect immediately. 22 (2) This section shall take effect immediately. 23 (3) The remainder of this act shall take effect July 1, 24 2005, or immediately, whichever is later.
