AN ACT 1 Providing that a percentage of tobacco litigation Master 2 Settlement Agreement funds be utilized for smoking cessation 3 and prevention; establishing the Tobacco Settlement Smoking 4 Cessation and Prevention Fund; and imposing duties upon the 5 Department of Health. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Tobacco Settlement Smoking Cessation and Prevention 9 Fund. 10 (a) Establishment of fund.--There is established in the 11 Treasury Department the Tobacco Settlement Smoking Cessation and 12 Prevention Fund. The moneys of the fund are hereby appropriated 13 to the Department of Health on a continuing basis for the 14 purpose of devising, improving and promoting the use of smoking 15 cessation and prevention programs. 16 (b) Funding.--On an annual basis, 25% of all moneys received 17 by the Commonwealth under the tobacco litigation Master
1 Settlement Agreement shall be deposited into the Tobacco 2 Settlement Smoking Cessation and Prevention Fund. 3 (c) Use of fund.--The Department of Health shall determine 4 need and use and allocate moneys of the fund through public 5 health agencies whenever possible. 6 (d) Definition.--As used in this section, the term "tobacco 7 litigation Master Settlement Agreement" means the Master 8 Settlement Agreement relating to tobacco litigation entered into 9 in 1998 by the Commonwealth and leading United States tobacco 10 product manufacturers. 11 Section 2.
