                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," providing for development
     4     of regulations for subsidized child day-care providers.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  The act of June 13, 1967 (P.L.31, No.21), known
     8  as the Public Welfare Code, is amended by adding a section to
     9  read:
    10     Section 215.  Regulations for Subsidized Child Day Care
    11  Providers.--(a)  The department shall develop regulations for
    12  individuals who directly provide child day care services which
    13  are subsidized in whole or in part by Federal or State funds but
    14  who are not otherwise subject to approval or licensure by the
    15  department under Articles IX and X.
    16     (b)  The regulations shall cover basic health and safety
    17  issues, including:

     1     (1)  mandatory criminal and child abuse clearance checks;
     2     (2)  prevention and control of infectious diseases;
     3     (3)  safety of the physical site, including smoke alarms and
     4  storage of toxic substances, weapons and firearms; and
     5     (4)  availability of training for caregivers in child health,
     6  safety and development.
     7     (c)  The regulations shall include procedures for determining
     8  if a provider subject to this section meets the requirements set
     9  forth in the regulations.
    10     (d)  No Federal or State funds for child day care services
    11  shall be authorized unless the department determines that the
    12  individual providing the child care is in compliance with the
    13  regulations.
    14     Section 2.  The Department of Public Welfare shall promulgate
    15  the regulations provided for in section 215 of the act within 60
    16  days of the effective date of this section.
    17     Section 3.  This act shall take effect immediately.
