SENATE BILL

           LOGAN, CORMAN AND ROBBINS, NOVEMBER 24, 2003

                                     AN ACT

     1  Amending Title 24 (Education) of the Pennsylvania Consolidated
     2     Statutes, further providing for Public School Employees'
     3     Retirement Board.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 8501(a) of Title 24 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 8501.  Public School Employees' Retirement Board.
     9     (a)  Status and membership.--The board shall be an
    10  independent administrative board and shall consist of [15] the
    11  following members: the Secretary of Education, ex officio; the
    12  State Treasurer, ex officio; two Senators; two members of the
    13  House of Representatives; the executive secretary of the
    14  Pennsylvania School Boards Association, ex officio; two to be
    15  appointed by the Governor, at least one of whom shall not be a
    16  school employee or an officer or employee of the State; three to
    17  be elected by the active professional members of the system from
    18  among their number; [one] three to be elected by annuitants from

     1  among their number; one to be elected by the active
     2  nonprofessional members of the system from among their number;
     3  and one to be elected by members of Pennsylvania public school
     4  boards from among their number. The appointments made by the
     5  Governor shall be confirmed by the Senate and each election
     6  shall be conducted in a manner approved by the board. The terms
     7  of the appointed and nonlegislative elected members shall be
     8  three years. The members from the Senate shall be appointed by
     9  the President pro tempore of the Senate and shall consist of one
    10  member from the majority and one member from the minority. The
    11  members from the House of Representatives shall be appointed by
    12  the Speaker of the House of Representatives and shall consist of
    13  one member from the majority and one member from the minority.
    14  The legislative members shall serve on the board for the
    15  duration of their legislative terms and shall continue to serve
    16  until 30 days after the convening of the next regular session of
    17  the General Assembly after the expiration of their respective
    18  legislative terms or until a successor is appointed for the new
    19  term, whichever occurs first. The chairman of the board shall be
    20  elected by the board members. Each ex officio member of the
    21  board, each elected member of the board and each legislative
    22  member of the board may appoint a duly authorized designee to
    23  act in his stead. The designee appointed by a member elected by
    24  the active professional members of the system must be an active
    25  professional member of the system. The designee appointed by a
    26  member elected by annuitants must be an annuitant. The designee
    27  appointed by a member elected by the active nonprofessional
    28  members of the system must be an active nonprofessional member
    29  of the system. The designee appointed by a member elected by
    30  members of the Pennsylvania public school boards must be a

     1  member of a Pennsylvania public school board.

     3     Section 2.  Nothing in this act shall preempt or supersede
     4  the terms of a collective bargaining agreement in effect on the
     5  effective date of this act for the term of that collective
     6  bargaining agreement unless otherwise agreed to in writing by
     7  the parties to the collective bargaining agreement.
     8     Section 3.  This act shall take effect immediately.
