                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," authorizing the acquisition of
     6     criminal history information pertaining to nonpublic school
     7     employees.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 111(h) of the act of March 10, 1949
    11  (P.L.30, No.14), known as the Public School Code of 1949,
    12  amended December 19, 1990 (P.L.1362, No.211), is amended to
    13  read:
    14     Section 111.  Background Checks of Prospective Employes;
    15  Conviction of Employes of Certain Offenses.--* * *
    16     (h)  [No] Except as provided in this subsection, no person
    17  employed in a public or private school on the effective date of
    18  this section shall be required to obtain the information
    19  required herein as a condition of continued employment. Any
    20  person who has once obtained the information required under this

     1  section may transfer to another school in the same district or
     2  established and supervised by the same organization and shall
     3  not be required to obtain additional reports before making such
     4  transfer. Nothing in this section shall prevent a private school
     5  from requiring an employe to obtain a report of criminal history
     6  record information from the Pennsylvania State Police or the
     7  Federal Bureau of Investigation as a condition of continued
     8  employment.

    10     Section 2.  This act shall take effect immediately.
