        SENATOR M. WHITE, ENVIRONMENTAL RESOURCES AND ENERGY, IN SENATE,
           AS AMENDED, NOVEMBER 9, 2004

                                     AN ACT

     1  Amending the act of December 3, 1998 (P.L.946, No.125), entitled
     2     "An act providing for the removal of waste illegally
     3     deposited on State forest and State park lands or abutting
     4     lands, for the closure of disposal sites, for the prevention
     5     of unauthorized waste disposal on State forest and State park
     6     lands or abutting lands and for grant programs; and
     7     establishing the Forest Lands Beautification Restricted
     8     Account," further providing for funding for the Forest Lands
     9     Beautification Restricted Account.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  Section 6 of the act of December 3, 1998
    13  (P.L.946, No.125), known as the Forest Lands Beautification Act,
    14  is amended to read:
    15  Section 6.  Funds.
    16     (a)  Establishment of restricted account.--There is hereby     <--
    17  established in the General Fund a restricted account to be known


     1  as the Forest Lands Beautification Restricted Account. For a
     2  period of five years from the effective date of this act, this
     3  account may receive up to $1,500,000 annually, upon approval of
     4  the Governor, from the Recycling Fund created by section 706 of
     5  the act of July 28, 1988 (P.L.556, No.101), known as the
     6  Municipal Waste Planning, Recycling and Waste Reduction Act.
     7  Moneys in the restricted account are hereby appropriated to the
     8  department to carry out the purposes of this act.
     9     (b)  Funding source.--For a period of ten years from the
    10  effective date of this subsection, the restricted account
    11  established under subsection (a) may receive up to $300,000
    12  annually, upon approval of the Governor, from the funds
    13  allocated and transferred to the Keystone Recreation, Park and
    14  Conservation Fund under section 1106-C(d) of the act of March 4,
    15  1971 (P.L.6, No.2), known as the Tax Reform Code of 1971.
    16     Section 2.  This act shall take effect in 60 days.
    17     THERE IS HEREBY ESTABLISHED IN THE GENERAL FUND A RESTRICTED   <--
    18  ACCOUNT TO BE KNOWN AS THE FOREST LANDS BEAUTIFICATION
    19  RESTRICTED ACCOUNT. FOR A PERIOD OF [FIVE] TEN YEARS FROM [THE
    20  EFFECTIVE DATE OF THIS ACT] DECEMBER 3, 1998, THIS ACCOUNT MAY
    21  RECEIVE UP TO [$1,500,000] $500,000 ANNUALLY, UPON APPROVAL OF
    22  THE GOVERNOR, FROM EITHER THE SOLID WASTE ABATEMENT FUND
    23  ESTABLISHED UNDER THE ACT OF JULY 7, 1980 (P.L.380, NO.97),
    24  KNOWN AS THE SOLID WASTE MANAGEMENT ACT, THE RECYCLING FUND
    25  CREATED BY SECTION 706 OF THE ACT OF JULY 28, 1988 (P.L.556,
    26  NO.101), KNOWN AS THE MUNICIPAL WASTE PLANNING, RECYCLING AND
    27  WASTE REDUCTION ACT, THE KEYSTONE RECREATION, PARK AND
    28  CONSERVATION FUND UNDER SECTION 1106-C(D) OF THE ACT OF MARCH 4,
    29  1971 (P.L.6, NO.2), KNOWN AS THE TAX REFORM CODE OF 1971, OR A
    30  COMBINATION THEREOF. MONEYS IN THE RESTRICTED ACCOUNT ARE HEREBY

     1  APPROPRIATED TO THE DEPARTMENT TO CARRY OUT THE PURPOSES OF THIS
     2  ACT.
     3     SECTION 2.  THIS ACT SHALL TAKE EFFECT IMMEDIATELY.
