           ENERGY, HOUSE OF REPRESENTATIVES, AS AMENDED, MARCH 24, 2004

                                     AN ACT

     1  Amending the act of December 3, 1998 (P.L.946, No.125), entitled
     2     "An act providing for the removal of waste illegally
     3     deposited on State forest and State park lands or abutting
     4     lands, for the closure of disposal sites, for the prevention
     5     of unauthorized waste disposal on State forest and State park
     6     lands or abutting lands and for grant programs; and
     7     establishing the Forest Lands Beautification Restricted
     8     Account," further providing for funding for the Forest Lands
     9     Beautification Restricted Account.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  Section 6 of the act of December 3, 1998
    13  (P.L.946, No.125), known as the Forest Lands Beautification Act,
    14  is amended to read:
    15  Section 6.  Funds.
    16     There is hereby established in the General Fund a restricted   <--
    17  account to be known as the Forest Lands Beautification
    18  Restricted Account. For a period of [five] ten years from the

     1  effective date of this act, [this] the restricted account may
     2  receive up to [$1,500,000] $500,000 annually, upon approval of
     3  the Governor, from the [Recycling Fund created by section 706 of
     4  the act of July 28, 1988 (P.L.556, No.101), known as the
     5  Municipal Waste Planning, Recycling and Waste Reduction Act]
     6  Solid Waste Abatement Fund established under the act of July 7,
     7  1980 (P.L.380, No.97), known as the Solid Waste Management Act.
     8  Moneys in the restricted account are hereby appropriated to the
     9  department to carry out the purposes of this act.
    10     (A)  ESTABLISHMENT OF RESTRICTED ACCOUNT.--THERE IS HEREBY     <--
    11  ESTABLISHED IN THE GENERAL FUND A RESTRICTED ACCOUNT TO BE KNOWN
    12  AS THE FOREST LANDS BEAUTIFICATION RESTRICTED ACCOUNT. FOR A
    13  PERIOD OF FIVE YEARS FROM THE EFFECTIVE DATE OF THIS ACT, THIS
    14  ACCOUNT MAY RECEIVE UP TO $1,500,000 ANNUALLY, UPON APPROVAL OF
    15  THE GOVERNOR, FROM THE RECYCLING FUND CREATED BY SECTION 706 OF
    16  THE ACT OF JULY 28, 1988 (P.L.556, NO.101), KNOWN AS THE
    17  MUNICIPAL WASTE PLANNING, RECYCLING AND WASTE REDUCTION ACT.
    18  MONEYS IN THE RESTRICTED ACCOUNT ARE HEREBY APPROPRIATED TO THE
    19  DEPARTMENT TO CARRY OUT THE PURPOSES OF THIS ACT.
    20     (B)  FUNDING SOURCE.--FOR A PERIOD OF TEN YEARS FROM THE
    21  EFFECTIVE DATE OF THIS SUBSECTION, THE RESTRICTED ACCOUNT
    22  ESTABLISHED UNDER SUBSECTION (A) MAY RECEIVE UP TO $300,000
    23  ANNUALLY, UPON APPROVAL OF THE GOVERNOR, FROM THE FUNDS
    24  ALLOCATED AND TRANSFERRED TO THE KEYSTONE RECREATION, PARK AND
    25  CONSERVATION FUND UNDER SECTION 1106-C(D) OF THE ACT OF MARCH 4,
    26  1971 (P.L.6, NO.2), KNOWN AS THE TAX REFORM CODE OF 1971.
    27     Section 2.  This act shall take effect in 60 days.
