HOUSE BILL

                                     AN ACT

     1  Amending the compact contained in the act of June 5, 1937
     2     (P.L.1664, No.348), entitled "An act to ratify and adopt a
     3     compact or agreement negotiated by commissioners designated
     4     by the Governor of the Commonwealth of Pennsylvania, and
     5     commissioners designated by the Governor of the State of
     6     Ohio, relative to the development, use, and control of the
     7     Pymatuning Lake and the State owned land surrounding said
     8     lake for fishing, hunting, recreational, and park purposes,"
     9     changing provisions relating to the operation of motor boats.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  Subdivision 5 of the compact contained in the act
    13  of June 5, 1937 (P.L.1664, No.348), entitled "An act to ratify
    14  and adopt a compact or agreement negotiated by commissioners
    15  designated by the Governor of the Commonwealth of Pennsylvania,
    16  and commissioners designated by the Governor of the State of
    17  Ohio, relative to the development, use, and control of the
    18  Pymatuning Lake and the State owned land surrounding said lake
    19  for fishing, hunting, recreational, and park purposes," amended
    20  December 22, 1993 (P.L.563, No.82), is amended to read:
    21     5.  Boats and Vessels.--No [hydroplanes or aquaplanes nor any
    22  type of boat equipped with a motor in excess of a ten horsepower

     1  rating shall be operated anywhere on said lake, except such]
     2  person shall operate any watercraft propelled by a single motor,
     3  or any combination of motors, that produces a horsepower rating
     4  in excess of twenty horsepower on Pymatuning Lake, except police
     5  or administration [motor boats, to] watercraft, the number which
     6  shall be mutually agreed upon by the parties hereto. [Sail
     7  boats, row boats, canoes, and boats propelled by a motor not in
     8  excess of ten horsepower shall be permitted, provided the
     9  owners] No person shall operate a watercraft without first
    10  obtain a license from the respective state of which the owner is
    11  a resident under such regulations as each party to this
    12  agreement may now have or hereafter adopt: Provided,
    13  nevertheless, That the use of any type of [boats] watercraft
    14  equipped with a motor is expressly limited and restricted to
    15  that portion of the lake extending from the main dam near
    16  Jamestown northwardly to the causeway at or near Linesville[:
    17  And provided further, That any boat]. Watercraft equipped with a
    18  motor in excess of [ten] twenty horsepower rating may be
    19  operated on said lake so long as such motor is not used. [A
    20  motor of not more than ten horsepower rating may be attached to
    21  the boat and used for propelling the boat on said lake.]
    22     No person shall ride or attempt to ride upon one or more
    23  water skis, surfboards, towed inflatable devices or similar
    24  devices or use or operate any vessel to tow a person thereon.
    25     Nothing contained in this subdivision shall be interpreted to
    26  effect a change in the level or flow of water as determined or
    27  fixed by the Department of [Environmental Resources]
    28  Conservation and Natural Resources.
    29     Any one who violates any of the provisions of this subsection
    30  or who operates any boat equipped with a motor on the lake

     1  without being authorized to do so under the provisions of this
     2  subdivision, shall, upon conviction thereof, be sentenced [to
     3  pay a fine not to exceed fifty dollars ($50) and costs of
     4  prosecution, and, in default of payment of the fine and costs,
     5  shall undergo imprisonment not to exceed thirty days.] in
     6  accordance with the applicable laws for the same or similar
     7  violations within the prosecuting jurisdiction, provided that
     8  the penalty for said violation shall not exceed a fine of five
     9  hundred dollars ($500) imprisonment for thirty days.
    10     Section 2.  This act shall be effective immediately upon its
    11  signing by the Governor and the passage by the State of Ohio of
    12  a substantially similar amendatory act ratifying the within
    13  change or alteration of the compact or agreement herein referred
    14  to.
