                                     AN ACT

     1  Amending the act of December 17, 1968 (P.L.1224, No.387),
     2     entitled "An act prohibiting unfair methods of competition
     3     and unfair or deceptive acts or practices in the conduct of
     4     any trade or commerce, giving the Attorney General and
     5     District Attorneys certain powers and duties and providing
     6     penalties," further providing for rescission of contracts.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 7(a) of the act of December 17, 1968
    10  (P.L.1224, No.387), known as the Unfair Trade Practices and
    11  Consumer Protection Law, reenacted and amended November 24, 1976
    12  (P.L.1166, No.260) and amended December 4, 1996 (P.L.906,
    13  No.146), is amended to read:
    14     Section 7.  Contracts; Effect of Rescission.--(a)  Where
    15  goods or services having a sale price of twenty-five dollars
    16  ($25) or more are sold or contracted to be sold to a buyer, as a
    17  result of, or in connection with, a seller-initiated contact
    18  with or seller-initiated call on the buyer or resident at his


     1  residence either in person or by telephone, that consumer may
     2  avoid the contract or sale by notifying, in writing, the seller
     3  within three full business days following the day on which the
     4  contract or sale was made and by returning or holding available
     5  for return to the seller, in its original condition, any
     6  merchandise received under the contract or sale. Such notice of
     7  rescission shall be effective upon depositing the same in the
     8  United States mail or upon other service which gives the seller
     9  notice of rescission.

    11     Section 2.  The amendment of section 7(a) of the act shall
    12  apply to contracts entered into on or after the effective date
    13  of this act.
    14     Section 3.  This act shall take effect in 60 days.
