                                     AN ACT

     1  Amending Title 66 (Public Utilities) of the Pennsylvania
     2     Consolidated Statutes, further providing for allocation of
     3     costs for construction, relocation, suspension and abolition
     4     of crossings.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 2702(c) of Title 66 of the Pennsylvania
     8  Consolidated Statutes is amended to read:
     9  § 2702.  Construction, relocation, suspension and abolition of
    10             crossings.

    12     (c)  Mandatory relocation, alteration, suspension or
    13  abolition.--Upon its own motion or upon complaint, the
    14  commission shall have exclusive power after hearing, upon notice
    15  to all parties in interest, including the owners of adjacent
    16  property, to order any such crossing heretofore or hereafter
    17  constructed to be relocated or altered, or to be suspended or
    18  abolished upon such reasonable terms and conditions as shall be


     1  prescribed by the commission. In determining the plans and
     2  specifications for any such crossing, the commission may lay
     3  out, establish, and open such new highways as, in its opinion,
     4  may be necessary to connect such crossing with any existing
     5  highway, or make such crossing more available to public use; and
     6  may abandon or vacate such highways or portions of highways as,
     7  in the opinion of the commission, may be rendered unnecessary
     8  for public use by the construction, relocation, or abandonment
     9  of any of such crossings. The commission may order the work of
    10  construction, relocation, alteration, protection, suspension or
    11  abolition of any crossing aforesaid to be performed in whole or
    12  in part by any public utility [or municipal corporation]
    13  concerned [or], by the Commonwealth or by an established
    14  nonprofit organization with a recreational or conservation
    15  purpose.

    17     Section 2.  This act shall take effect in 60 days.
