                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for penalties involving alteration of
     3     physician statements regarding application for special
     4     disability plate or parking placard and for penalties
     5     regarding violations of handicapped persons and disabled
     6     veterans parking places.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 1338(d) of Title 75 of the Pennsylvania
    10  Consolidated Statutes is amended to read:
    11  § 1338.  Person with disability plate and placard.

    13     (d)  Penalty.--[Any]
    14         (1)  Except as provided for in paragraph (2), any person
    15     violating this section commits a summary offense and shall,
    16     upon conviction, be sentenced to pay a fine of [not more
    17     than] $100.
    18         (2)  Any person who alters or falsifies a physician's
    19     statement after the physician has prepared the certificate or

     1     statement commits a misdemeanor of the third degree and
     2     shall, upon conviction, be sentenced to pay a fine of $1,000
     3     or to imprisonment for not more than 90 days, or both.
     4     Section 2.  Section 3354(f) of Title 75, amended October 4,
     5  2002 (P.L.845, No.123), is amended to read:
     6  § 3354.  Additional parking regulations.

     8     (f)  Penalty.--A person violating subsection (a), (b) or
     9  (d)(1) is guilty of a summary offense and shall, upon
    10  conviction, be sentenced to pay a fine of not more than $15. A
    11  person violating subsection (d)(2) or (3) or (e) is guilty of a
    12  summary offense and shall, upon conviction, be sentenced to pay
    13  a fine of [not less than $50 nor more than $200] $500. If a
    14  person is convicted under subsection (d)(2) or (3) in the
    15  absense of a sign stating the penalty amount, the fine imposed
    16  may not exceed $50.

    18     Section 3.  This act shall take effect in 60 days.
