        INTRODUCED BY ROBBINS, BELL, LEMMOND, MUSTO, ORIE, ERICKSON,
           WENGER, THOMPSON, LAVALLE, COSTA, BOSCOLA, ARMSTRONG,
           SCHWARTZ, M. WHITE, WAUGH AND WAGNER, OCTOBER 9, 2001

        SENATOR TOMLINSON, MILITARY AND VETERANS AFFAIRS, AS AMENDED,
           NOVEMBER 14, 2001

                                     AN ACT

     1  Amending the act of April 8, 1868 (P.L.73, No.37), entitled "An
     2     act to authorize the recorder of deeds in the several
     3     counties of this Commonwealth to record the discharges of all
     4     honorably discharged officers and soldiers," further
     5     providing for the recording of final discharges and reports
     6     of separation and similar forms.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 1 of the act of April 8, 1868 (P.L.73,
    10  No.37), entitled, "An act to authorize the recorder of deeds in
    11  the several counties of this Commonwealth to record the
    12  discharges of all honorably discharged officers and soldiers,"
    13  amended May 22, 1953 (P.L.215, No. 25), is amended to read:
    14     Section 1.  Final discharges of officers and persons in Armed
    15  Forces or women's organizations; certificates of service;
    16  reports of separation and similar forms
    17     The Recorders of Deeds in the several counties of this
    18  Commonwealth are hereby authorized and required to record all
    19  final discharges of all honorably discharged non-commissioned

     1  officers, and persons who were duly enlisted and mustered into
     2  the Armed Forces of the United States, a reserve component of
     3  the Armed Forces of the United States AS DEFINED IN 51 PA.C.S. §  <--
     4  7301 (RELATING TO DEFINITIONS), or in any women's organization
     5  officially connected therewith, and all certificates of service
     6  issued to commissioned officers upon termination of active
     7  service as aforesaid and as well as reports of separation from
     8  the Armed Forces of the United States or a reserve component
     9  thereof, commonly known as [dd] DD form 214, NGB form 22 and
    10  similar forms delivered to members of the armed services upon
    11  their retirement or separation from active duty, upon
    12  application being made to them by the holders thereof, their
    13  agents, attorneys, or legal representatives, for which the
    14  recorder shall be allowed a fee of fifty cents for recording the
    15  same, which fee shall be paid by the county where such discharge
    16  is recorded, upon the presentation to the county commissioners
    17  of proper vouchers by the recorder recording the same, and the
    18  recording of the same shall not be subject to the payment of the
    19  usual State tax: Provided, That the provisions of this act
    20  relating to the fees of the recorder and the state tax shall not
    21  apply to holders of discharges who are not residents of this
    22  Commonwealth at the time of making their applications to the
    23  recorder for placing the same of record.
    24     Section 2.  This act shall take effect in 60 days.
