                                     AN ACT

     1  Amending the act of July 6, 1989 (P.L.169, No.32), entitled, as
     2     amended, "An act providing for the regulation of storage
     3     tanks and tank facilities; imposing additional powers and
     4     duties on the Department of Environmental Protection and the
     5     Environmental Quality Board; and making an appropriation,"
     6     authorizing a political subdivision property tax program.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of July 6, 1989 (P.L.169, No.32), known
    10  as the Storage Tank and Spill Prevention Act, is amended by
    11  adding a section to read:
    12  Section 713.  Political subdivision property reassessment
    13             reimbursement program.
    14     (a)  Establishment.--The board is hereby authorized to
    15  establish a political subdivision property tax reimbursement
    16  program for the purpose of reimbursing political subdivisions
    17  for revenues lost due to reassessments of property.
    18  Reimbursement under this program may only be made if the
    19  reassessed value of property decreases as a result of a release
    20  from a storage tank.

     1     (b)  Allocation.--The board may allocate up to $2,000,000
     2  annually from the Underground Storage Tank Indemnification Fund
     3  for the political subdivision property tax reimbursement program
     4  as long as the allocation does not impede the actuarial
     5  soundness of the fund's ability to pay claims.
     6     (c)  Implementation.--The board shall establish policies,
     7  procedures and forms as may be necessary and appropriate in
     8  order to administer the political subdivision property tax
     9  reimbursement program established under this section. The
    10  Department of Community and Economic Development and the
    11  Department of Environmental Protection shall assist the board
    12  with the implementation of this program.
    13     Section 2.  This act shall take effect in 60 days.
