                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for certificate of title in beneficiary
     3     form and related fee.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 75 of the Pennsylvania Consolidated
     7  Statutes is amended by adding sections to read:
     8  § 1101.1.  Certificate of title in beneficiary form.
     9     (a)  General rule.--Title to a vehicle subject to
    10  registration may be held in beneficiary form that includes a
    11  direction to transfer ownership of the vehicle to a designated
    12  beneficiary on the death of the owner if both of the following
    13  requirements are satisfied:
    14         (1)  Only one owner is designated.
    15         (2)  Only one transfer on death (TOD) beneficiary is
    16     designated.


     1     (b)  Form.--A certificate of title issued in beneficiary form
     2  shall include, after the name of the owner, the words "transfer
     3  on death to" or the abbreviation "TOD" followed by the name of
     4  the beneficiary.
     5     (c)  Signature of beneficiary not required.--During the
     6  lifetime of the owner, the signature or consent of the
     7  beneficiary is not required for any transaction relating to the
     8  vehicle for which a certificate of title in beneficiary form has
     9  been issued.
    10     (d)  Certificate of title to beneficiary.--On application
    11  accompanied by proof of death of the owner and, where
    12  applicable, surrender of the outstanding certificate of title,
    13  the department shall issue a certificate of title to the
    14  beneficiary, subject to any outstanding security interest.
    15  § 1953.1.  Certificate of title to beneficiary.
    16     The fee for issuance of a certificate of title to a
    17  beneficiary upon the death of the vehicle owner is $5.
    18     Section 2.  This act shall take effect in 60 days.
