                                     AN ACT

     1  To provide from the General Fund for the expenses of the
     2     Executive, Legislative and Judicial Departments of the
     3     Commonwealth, the public debt and for the public schools for
     4     the fiscal year July 1, 2002, to June 30, 2003, for certain
     5     institutions and organizations, and for the payment of bills
     6     incurred and remaining unpaid at the close of the fiscal year
     7     ending June 30, 2002; to provide appropriations from the
     8     State Lottery Fund, the Energy Conservation and Assistance
     9     Fund, the Hazardous Material Response Fund, The State Stores
    10     Fund, the Milk Marketing Fund, the Home Investment Trust
    11     Fund, the Emergency Medical Services Operating Fund, the
    12     Tuition Payment Fund, the Banking Department Fund, the
    13     Firearm Records Check Fund and the Ben Franklin Technology
    14     Development Authority Fund to the Executive Department; to
    15     provide appropriations from the Judicial Computer System
    16     Augmentation Account to the Judicial Department for the
    17     fiscal year July 1, 2002, to June 30, 2003; to provide
    18     appropriations from the Motor License Fund for the fiscal
    19     year July 1, 2002, to June 30, 2003, for the proper operation
    20     of the several departments of the Commonwealth and the
    21     Pennsylvania State Police authorized to spend Motor License
    22     Fund moneys; to provide for the appropriation of Federal
    23     funds to the Executive Department of the Commonwealth and for
    24     the establishment of restricted receipt accounts for the
    25     fiscal year July 1, 2002, to June 30, 2003, and for the
    26     payment of bills remaining unpaid at the close of the fiscal
    27     year ending June 30, 2002.

     5  Section 2001.  Effective date.
     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8                               PART I
     9                         GENERAL PROVISIONS
    10     Section 101.  Short title.--This act shall be known and may
    11  be cited as the General Appropriation Act of 2002.
    12     Section 102.  Definitions.--The following words and phrases
    13  when used in this act shall have the meanings given to them in
    14  this section unless the context clearly indicates otherwise:
    15     "Employees."  Includes all directors, superintendents, bureau
    16  or division chiefs, assistant directors, assistant
    17  superintendents, assistant chiefs, experts, scientists,
    18  engineers, surveyors, draftsmen, accountants, secretaries,
    19  auditors, inspectors, examiners, analysts, statisticians,
    20  marshals, clerks, stenographers, bookkeepers, messengers and
    21  other assistants in any department, board or commission.
    22     "Expenses" and "maintenance."  Includes all printing, binding
    23  and stationery, food and forage, materials and supplies,
    24  traveling expenses, training, motor vehicle supplies and
    25  repairs, freight, express and cartage, postage, telephones and
    26  telegraph rentals and toll charges, newspaper advertising and
    27  notices, public advertising by or through any medium, fuel,
    28  light, heat, power and water, minor construction and renovation,
    29  repairs or reconstruction of equipment, buildings and
    30  facilities, rent of real estate and equipment, premiums on

     1  workers' compensation, insurance premiums on policies of
     2  liability insurance, insurance premiums on medical payment
     3  insurance and surety bonds for volunteer workers, premiums on
     4  employee group life insurance and employee and retired employee
     5  group hospital and medical insurance, payment of Commonwealth
     6  share of Social Security taxes and unemployment compensation
     7  costs for State employees, the purchase of replacement or
     8  additional equipment and machinery and all other incidental
     9  costs and expenses, including payment to the Department of
    10  General Services of mileage and other charges for the use of
    11  automobiles and rental payments for permanently assigned
    12  automobiles and of expenses or costs of services incurred
    13  through the Purchasing Fund. The term "expenses" also shall
    14  include the medical costs for the treatment of inmates of State
    15  institutions when the inmate must be transferred to an outside
    16  hospital: Provided, That in no case shall the State institution
    17  pay more for patient care than that provided under the State
    18  medical assistance program.
    19     Section 103.  Abbreviations.--The following abbreviations
    20  when used in this act shall have the meanings given to them in
    21  this section unless the context clearly indicates otherwise:
    22     "ARC."  Appalachian Regional Commission.
    23     "BG."  Block grant.
    24     "CCDFBG."  Child Care and Development Fund Block Grant.
    25     "CSBG."  Community Services Block Grant.
    26     "DCSI."  Drug Control and Systems Improvement Formula Grant
    27  Program.
    28     "DFSC."  Drug Free Schools and Communities Act.
    29     "DOE."  Department of Energy.

    21     Section 104.  State appropriations.--(a)  General Fund.--The
    22  following sums set forth in this act, or as much thereof as may
    23  be necessary, are hereby specifically appropriated from the
    24  General Fund to the several hereinafter named agencies of the
    25  Executive, Legislative and Judicial Departments of the
    26  Commonwealth for the payment of salaries, wages or other
    27  compensation and travel expenses of the duly elected or
    28  appointed officers and employees of the Commonwealth, for the
    29  payment of fees for contractual services rendered, for the
    30  purchase or rental of goods and services, printing, public

     1  advertising by or through any medium, equipment, land and
     2  buildings and for payment of any other expenses, as provided by
     3  law or by this act, necessary for the proper conduct of the
     4  duties, functions and activities and for the purposes
     5  hereinafter set forth for the fiscal year beginning July 1,
     6  2002, and for the payment of bills incurred and remaining unpaid
     7  at the close of the fiscal year ending June 30, 2002.
     8     (b)  State Lottery Fund.--The following sums set forth in
     9  this act, or as much thereof as may be necessary, are hereby
    10  specifically appropriated from the State Lottery Fund to the
    11  several hereinafter named agencies of the Executive Department
    12  of the Commonwealth for the payment of salaries, wages or other
    13  compensation and travel expenses of the duly appointed officers
    14  and employees of the Commonwealth, for the payment of fees for
    15  contractual services rendered, for the purchase or rental of
    16  goods and services and for payment of any other expenses, as
    17  provided by law or by this act, necessary for the proper conduct
    18  of the duties, functions and activities and for the purposes
    19  hereinafter set forth for the fiscal year beginning July 1,
    20  2002, and for the payment of bills incurred and remaining unpaid
    21  at the close of the fiscal year ending June 30, 2002.
    22     (c)  Energy Conservation and Assistance Fund.--The following
    23  sums set forth in this act, or as much thereof as may be
    24  necessary, are hereby specifically appropriated from the Energy
    25  Conservation and Assistance Fund to the several hereinafter
    26  named agencies of the Executive Department of the Commonwealth
    27  for the payment of fees for contractual services rendered, for
    28  the purchase or rental of goods and services and for the payment
    29  of any other expenses, as provided by law or by this act,
    30  necessary for the proper conduct of the duties, functions and

     1  activities and for the purposes hereinafter set forth for the
     2  fiscal year beginning July 1, 2002, and for the payment of bills
     3  incurred and remaining unpaid at the close of the fiscal year
     4  ending June 30, 2002.
     5     (d)  Judicial Computer System Augmentation Account.--The
     6  following sums set forth in this act, or as much thereof as may
     7  be necessary, are hereby specifically appropriated from the
     8  restricted receipt account established within the General Fund,
     9  known as the Judicial Computer System Augmentation Account, to
    10  the Judicial Department of the Commonwealth for the payment of
    11  salaries, wages or other compensation and travel expenses, for
    12  the payment of fees for contractual services rendered, for the
    13  purchase or rental of goods and services and for the payment of
    14  any other expenses, as provided by law or by this act, necessary
    15  for the proper conduct of the duties, functions and activities
    16  and for the purposes hereinafter set forth for the fiscal year
    17  beginning July 1, 2002, and for the payment of bills incurred
    18  and remaining unpaid at the close of the fiscal year ending June
    19  30, 2002.
    20     (e)  Emergency Medical Services Operating Fund.--The
    21  following sums set forth in this act, or as much thereof as may
    22  be necessary, are hereby specifically appropriated from the
    23  Emergency Medical Services Operating Fund to the several
    24  hereinafter named agencies of the Executive Department of the
    25  Commonwealth for the payment of fees for contractual services
    26  rendered, for the purchase or rental of goods and services and
    27  for the payment of any other expenses, as provided by law or by
    28  this act, necessary for the proper conduct of the duties,
    29  functions and activities and for the purposes hereinafter set
    30  forth for the fiscal year beginning July 1, 2002, and for the

     1  payment of bills incurred and remaining unpaid at the close of
     2  the fiscal year ending June 30, 2002.
     3     (f)  The State Stores Fund.--The following sums set forth in
     4  this act, or as much thereof as may be necessary, are hereby
     5  specifically appropriated from The State Stores Fund to the
     6  hereinafter named agency of the Executive Department of the
     7  Commonwealth for the payment of salaries, wages or other
     8  compensation and travel expenses of the duly appointed officers
     9  and employees of the Commonwealth, for the payment of fees for
    10  contractual services rendered, for the purchase or rental of
    11  goods and services and for the payment of any other expenses, as
    12  provided by law or by this act, necessary for the proper conduct
    13  of the duties, functions and activities and for the purposes
    14  hereinafter set forth for the fiscal year beginning July 1,
    15  2002, and for the payment of bills incurred and remaining unpaid
    16  at the close of the fiscal year ending June 30, 2002.
    17     (g)  Motor License Fund.--The following sums, or as much
    18  thereof as may be necessary, are hereby appropriated from the
    19  Motor License Fund to the hereinafter named agencies of the
    20  Executive Department for the payment of salaries, wages and
    21  other compensation and travel expenses of the duly elected or
    22  appointed officers and employees of the Commonwealth, for
    23  contractual services and other expenses necessary for the proper
    24  conduct of the duties, functions and activities for the purposes
    25  hereinafter set forth for the fiscal year beginning July 1,
    26  2002, and for the payment of bills incurred and remaining unpaid
    27  at the close of the fiscal year ending June 30, 2002.
    28     (h)  Aviation Restricted Revenue Account.--The following
    29  sums, or as much thereof as may be necessary, are hereby
    30  appropriated from the Aviation Restricted Revenue Account in the

     1  Motor License Fund to the hereinafter named agencies of the
     2  Executive Department for the purposes set forth herein for the
     3  fiscal year beginning July 1, 2002, and for the payment of bills
     4  incurred and remaining unpaid at the close of the fiscal year
     5  ending June 30, 2002.
     6     (i)  Hazardous Material Response Fund.--The following sums
     7  set forth in this act, or as much thereof as may be necessary,
     8  are hereby specifically appropriated from the Hazardous Material
     9  Response Fund to the several hereinafter named agencies of the
    10  Executive Department of the Commonwealth for the payment of fees
    11  for contractual services rendered, for the purchase or rental of
    12  goods and services and for the payment of any other expenses, as
    13  provided by law or by this act, necessary for the proper conduct
    14  of the duties, functions and activities and for the purposes
    15  hereinafter set forth for the fiscal year beginning July 1,
    16  2002, and for the payment of bills incurred and remaining unpaid
    17  at the close of the fiscal year ending June 30, 2002.
    18     (j)  Milk Marketing Fund.--The following sums set forth in
    19  this act, or as much thereof as may be necessary, are hereby
    20  specifically appropriated from the Milk Marketing Fund to the
    21  several hereinafter named agencies of the Executive Department
    22  of the Commonwealth for the payment of salaries, wages or other
    23  compensation and travel expenses of the duly appointed officers
    24  and employees of the Commonwealth, for the payment of fees for
    25  contractual services rendered, for the purchase or rental of
    26  goods and services and for the payment of any other expenses, as
    27  provided by law or by this act, necessary for the proper conduct
    28  of the duties, functions and activities and for the purposes
    29  hereinafter set forth for the fiscal year beginning July 1,
    30  2002, and for the payment of bills incurred and remaining unpaid

     1  at the close of the fiscal year ending June 30, 2002.
     2     (k)  Home Investment Trust Fund.--The following sums set
     3  forth in this act, or as much thereof as may be necessary, are
     4  hereby specifically appropriated from the Home Investment Trust
     5  Fund to the hereinafter named agencies of the Executive
     6  Department of the Commonwealth for the payment of salaries,
     7  wages or other compensation and travel expenses of the duly
     8  appointed officers and employees of the Commonwealth, for the
     9  payment of fees for contractual services rendered, for the
    10  purchase or rental of goods and services and for the payment of
    11  any other expenses, as provided by law or by this act, necessary
    12  for the proper conduct of the duties, functions and activities
    13  and for the purposes hereinafter set forth for the fiscal year
    14  beginning July 1, 2002, and for the payment of bills incurred
    15  and remaining unpaid at the close of the fiscal year ending June
    16  30, 2002.
    17     (l)  Tuition Payment Fund.--The following sums set forth in
    18  this act, or as much thereof as may be necessary, are hereby
    19  specifically appropriated from the Tuition Payment Fund to the
    20  hereinafter named agencies of the Executive Department of the
    21  Commonwealth for the payment of salaries, wages or other
    22  compensation and travel expenses of the duly appointed officers
    23  and employees of the Commonwealth, for the payment of fees for
    24  contractual services rendered, for the purchase or rental of
    25  goods and services and for the payment of any other expenses, as
    26  provided by law or by this act, necessary for the proper conduct
    27  of the duties, functions and activities and for the purposes
    28  hereinafter set forth for the fiscal year beginning July 1,
    29  2002, and for the payment of bills incurred and remaining unpaid
    30  at the close of the fiscal year ending June 30, 2002.

     1     (m)  Banking Department Fund.--The following sums set forth
     2  in this act, or as much thereof as may be necessary, are hereby
     3  specifically appropriated from the Banking Department Fund to
     4  the hereinafter named agencies of the Executive Department of
     5  the Commonwealth for the payment of salaries, wages or other
     6  compensation and travel expenses of the duly appointed officers
     7  and employees of the Commonwealth, for the payment of fees for
     8  contractual services rendered, for the purchase or rental of
     9  goods and services and for the payment of any other expenses, as
    10  provided by law or by this act, necessary for the proper conduct
    11  of the duties, functions and activities and for the purposes
    12  hereinafter set forth for the fiscal year beginning July 1,
    13  2002, and for the payment of bills incurred and remaining unpaid
    14  at the close of the fiscal year ending June 30, 2002.
    15     (n)  Firearm Records Check Fund.--The following sums set
    16  forth in this act, or as much thereof as may be necessary, are

     6  cities and communities that have a high concentration of
     7  impoverished citizens and substandard housing to expand their
     8  low-income and moderate-income housing opportunities and to meet
     9  community development needs.
    10     (c)  Community Services Block Grant.--The Community Services
    11  Block Grant (CSBG) is to provide a range of services and
    12  activities having a measurable and potentially major impact on
    13  the causes of poverty in the community or those areas of the
    14  community where poverty is a particularly acute problem. In
    15  addition, new focus may be placed on the unemployed, both old
    16  and new. Local agencies may lower their eligibility requirements
    17  for recipients to three months to allow greater flexibility to
    18  assure proper consideration of each recipient.
    19     (d)  Preventive Health and Health Services Block Grant.--The
    20  Preventive Health and Health Services Block Grant (PHHSBG) is
    21  for the provision of preventive health and other health services
    22  related to emergency medical systems, health initiative grants,
    23  comprehensive public health, hypertension, fluoridation, health
    24  education, risk reduction, home health, rape crisis and domestic
    25  violence services.
    26     (e)  Maternal and Child Health Services Block Grant.--The
    27  Maternal and Child Health Services Block Grant (MCHSBG) is to
    28  enable states to maintain and strengthen their leadership in
    29  planning, promoting, coordinating and evaluating health care for
    30  pregnant women, mothers, infants and children, and children with

     1  special health care needs, and in providing health services for
     2  mothers and children who do not have access to adequate health
     3  care.
     4     (f)  Low-Income Home Energy Assistance Block Grant.--The Low-
     5  Income Home Energy Assistance Block Grant (LIHEABG) is to help
     6  lessen the impact of the high cost of energy on low-income
     7  families and individuals, including energy efficiency grants for
     8  low-income dwellings. No less than 15% of the LIHEABG funds
     9  received shall be used for weatherization. LIHEABG funds
    10  received pursuant to a Presidential release of contingency funds
    11  shall be exempt from the 15% requirement. Unexpended
    12  weatherization funds which would result in LIHEABG funds being
    13  returned to the Federal Department of Health and Human Services
    14  may be spent for assistance grants at the discretion of the
    15  Secretary of the Budget. The Secretary of the Budget shall
    16  notify the chairman and the minority chairman of the
    17  Appropriations Committee of the Senate and the chairman and the
    18  minority chairman of the Appropriations Committee of the House
    19  of Representatives of the intent to reallocate any such funds
    20  ten days prior to any reallocation.
    21     (g)  Social Services Block Grant.--The Social Services Block
    22  Grant (SSBG) is for the provision of social services to eligible
    23  persons.
    24     (h)  Mental Health Services Block Grant.--The Mental Health
    25  Services Block Grant (MHSBG) provides funds for the provision of
    26  services to adults with serious mental illness or children with
    27  serious emotional disturbance.
    28     (i)  Substance Abuse Block Grant.--The Substance Abuse Block
    29  Grant (SABG) provides funds to establish and maintain programs
    30  to combat alcohol and drug abuse.

    30  may be used for the purposes prescribed by the Federal

     1  Government.
     2     (b)  In addition to the moneys appropriated by this act, all
     3  moneys received from the Federal Government for the purpose of
     4  disaster assistance or relief, or other moneys received as a
     5  direct result of terrorist acts and moneys for homeland security
     6  and defense, shall be paid into the General Fund and are hereby
     7  appropriated out of the General Fund to the departments, boards,
     8  commissions or agencies designated by the Governor.
     9     (c)  In the event of any emergency situation in which the
    10  General Assembly cannot act in sufficient time, the Governor is
    11  authorized through executive authorization to provide up to
    12  $10,000,000 in Federal funds to alleviate the emergency
    13  situation. For the purposes of this section, "emergency" is
    14  defined as any situation in which there is a chance of or which
    15  may result in substantial human suffering.
    16     Section 1806.  Transfer of funds from TANFBG to CCDFBG and
    17  SSBG.--In accordance with Federal law which permits the transfer
    18  of funds from the TANFBG to the CCDFBG and SSBG, the Department
    19  of Public Welfare, upon approval of the Secretary of the Budget,
    20  may make such transfers of funds provided that any such transfer
    21  will not result in a deficit in any appropriation from which
    22  funds are transferred. The Secretary of the Budget shall provide
    23  notification of any such transfers to the chairman and the
    24  minority chairman of the Appropriations Committee of the Senate
    25  and the chairman and minority chairman of the Appropriations
    26  Committee of the House of Representatives.
    27     Section 1807.  Transfer of LIHEAP funds.--(a)  The Department
    28  of Public Welfare, upon approval of the Secretary of the Budget,
    29  may transfer up to 15% of any additional funds received for the
    30  LIHEAP program either through an increase in the regular program

     1  or a Presidential release of contingency funds, to the
     2  Department of Economic and Community Development for the LIHEAP
     3  - Weatherization Program. The Secretary of the Budget shall
     4  provide notification of any such transfers to the chairman and
     5  minority chairman of the Appropriations Committee of the Senate
     6  and the chairman and minority chairman of the Appropriations
     7  Committee of the House of Representatives.
     8     (b)  The Department of Public Welfare, upon approval of the
     9  Secretary of the Budget, may transfer LIHEAP administrative
    10  funds to the Department of Economic and Community Development
    11  subject to any limitations under Federal law. The Secretary of
    12  the Budget shall provide notification of any such transfer to
    13  the chairman and minority chairman of the Appropriations
    14  Committee of the Senate and the chairman and minority chairman
    15  of the Appropriations Committee of the House of Representatives.
    16                              PART XIX
    17               MISCELLANEOUS PROVISIONS FOR 2002-2003
    18     Section 1901.  Prior laws unaffected.--Except as provided in
    19  section 253, this act is not intended to be inconsistent with or
    20  to repeal any provision of any act enacted at this or any prior
    21  session of the General Assembly regulating the purchase of
    22  supplies, the ordering of printing and binding, the purchase,
    23  maintenance and use of automobiles, the method of making
    24  payments from the State Treasury for any purpose or the
    25  functioning of any administrative department, board or
    26  commission.
    27     Section 1902.  Compliance with other law before funds
    28  available.--No appropriation made by this act to any department,
    29  board, commission or agency of the Executive Department shall be
    30  available unless and until the department, board, commission or

     1  agency has complied with sections 615 and 616 of the act of
     2  April 9, 1929 (P.L.177, No.175), known as The Administrative
     3  Code of 1929.
     4     Section 1903.  Contracts prerequisite to encumbering or
     5  committing funds.--Funds available to agencies, boards,
     6  departments, commissions, or other governmental entities under
     7  this act for the procurement of supplies, services or
     8  construction shall not be available for payment of, or to be
     9  committed to or encumbered for payment of, any such procurement
    10  unless and until the agency, board, department or other
    11  governmental entity has complied with all of the requirements
    12  applicable to the procurement that are set out in 62 Pa.C.S.
    13  (relating to procurement) and in the policies, procedures and
    14  regulations instituted in accordance with that code.
    15     Section 1904.  Minority business set-asides.--(a)  Each
    16  department or other instrumentality of the Commonwealth listed
    17  in Subpart A of Part II authorized to contract for buildings,
    18  highways, commodities, equipment, supplies or services shall
    19  report to the General Assembly all information pertinent to
    20  anticipated procurement needs at the beginning of each fiscal
    21  year and each fiscal quarter thereafter.
    22     (b)  As used in this section, the term "minority business"
    23  means a minority business enterprise as defined in the act of
    24  July 22, 1974 (P.L.598, No.206), known as the Pennsylvania
    25  Minority Business Development Authority Act.
    26     Section 1905.  Appropriation of funds from miscellaneous
    27  sources.--(a)  In addition to the amounts appropriated by this
    28  act, moneys received in payment for food and household supplies
    29  furnished to employees and other persons, except inmates, by an
    30  institution, and moneys received from the proceeds from the sale

     1  of any products of the soil, meats, livestock, timber or other
     2  materials sold by the department shall be paid into the General
     3  Fund and are hereby appropriated out of the General Fund to the
     4  several respective institutions for the operation and
     5  maintenance of the institutions.
     6     (b)  In addition to the amounts appropriated by this act, all
     7  moneys received from any other source, except the Federal
     8  Government, as contributions for the programs provided herein or
     9  as payment for services or materials furnished by one
    10  institution to another, except those collections designated as
    11  revenues, shall be paid into the General Fund and are hereby
    12  appropriated out of the General Fund for the purposes of the
    13  respective appropriations.
    14     (c)  In addition to any funds specifically appropriated by
    15  this act, all moneys received by a department or agency of the
    16  Commonwealth from any other sources, except the Federal
    17  Government, as contributions or supplements to the department or
    18  agency for a program or administration of an act included in
    19  this act shall be paid into the General Fund and credited to the
    20  appropriation for that program or administration of the act.
    21     Section 1906.  Lapsing of unused funds.--(a)  Except as
    22  otherwise provided by law or by this section, that part of all
    23  appropriations in Parts II, III, IV, V, VI, VII, VIII, IX, X,
    24  XI, XII, XIII, XIV and XV unexpended, uncommitted or
    25  unencumbered as of June 30, 2003, shall automatically lapse as
    26  of that date.
    27     (b)  The appropriations in Part II to the Legislative
    28  Department shall be continuing appropriations.
    29     Section 1907.  Appellate courts appropriation contingency.--
    30  The funds appropriated in Part II to the Supreme, Superior and

     1  Commonwealth Courts for justice and judge expenses are
     2  contingent upon a vouchered expense account plan being continued
     3  by the Supreme Court.
     4     Section 1908.  Transfer of excess funds.--The Governor may
     5  transfer any excess money in those funds receiving proceeds of
     6  Commonwealth of Pennsylvania general obligation bonds in excess
     7  of the amount necessary for the purposes for which the bonds
     8  were issued to the appropriate sinking fund for payment of debt
     9  service due on outstanding bonds. If such excess funds, together
    10  with any available balance, exceed the amount of debt service
    11  remaining to be paid, the funds shall be transferred to the
    12  General Fund or to the appropriate special fund responsible for
    13  such debt service.
    14     Section 1909.  Transfer of funds by the Supreme Court.--(a)
    15  The Supreme Court may transfer any excess funds appropriated in
    16  sections 281, 285, 286, 287 and 291 to the Judicial Department
    17  in Part II to the Judicial Computer Augmentation Account during
    18  the month of June 2003. No transfer may create or increase a
    19  deficiency in the appropriation from which the transfer is made.
    20  Whenever the Supreme Court makes a transfer under this
    21  subsection, the Supreme Court shall give written notification to
    22  the Secretary of the Budget and chairman and minority chairman
    23  of the Senate Committee on Appropriations and the chairman and
    24  the minority chairman of the House of Representatives Committee
    25  on Appropriations ten days prior to any transfer which shall
    26  also include certification that such transfer will not result in
    27  a deficit in any appropriation.
    28     (b)  The Supreme Court may transfer funds appropriated in
    29  section 281 between the line items in that section provided that
    30  no transfer may create or increase a deficiency in the

     1  appropriation from which the transfer is made. Whenever the
     2  Supreme Court makes a transfer under this subsection, the
     3  Supreme Court shall give written notification to the Secretary
     4  of the Budget and the chairman and minority chairman of the
     5  Senate Committee on Appropriations and the chairman and the
     6  minority chairman of the House of Representatives Committee on
     7  Appropriations ten days prior to any transfer which shall also
     8  include certification that such transfer will not result in a
     9  deficit in any appropriation.
    10     Section 1910.  Transfer from Hazardous Sites Cleanup Fund.--
    11  The sum of $8,000,000 is transferred from the Hazardous Sites
    12  Cleanup Fund to the Industrial Sites Cleanup Fund.
    13                              PART XX
    14                           EFFECTIVE DATE
    15     Section 2001.  Effective date.--This act shall take effect
    16  July 1, 2002, or immediately, whichever is later.
