AN ACT 1 Amending Title 71 (State Government) of the Pennsylvania 2 Consolidated Statutes, further providing for termination of 3 annuities. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 5706(a.1) of Title 71 of the Pennsylvania 7 Consolidated Statutes is amended to read: 8 § 5706. Termination of annuities. 9 * * * 10 (a.1) Return to State service during emergency or to certain 11 institutions.-- 12 (1) When, in the judgment of the employer, an emergency 13 creates an increase in the work load such that there is 14 serious impairment of service to the public, an annuitant may 15 be returned to State service for a period not to exceed 95 16 days in any calendar year without loss of his annuity. In
1 computing the number of days an annuitant has returned to 2 State service, any amount of time less than one-half of a day 3 shall be counted as one-half of a day. For agencies, boards 4 and commissions under the Governor's jurisdiction, the 5 approval of the Governor that an emergency exists shall be 6 required before an annuitant may be returned to State 7 service. 8 (2) Notwithstanding the provisions of paragraph (1), an 9 annuitant may return to State service without loss of his 10 annuity if the annuitant returns as an employee of a 11 university within the State System of Higher Education. 12 * * * 13 Section 2.
