                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for members of the
     6     Councils of Trustees of institutions of the State System of
     7     Higher Education.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 2008-A of the act of March 10, 1949
    11  (P.L.30, No.14), known as the Public School Code of 1949,
    12  amended June 23, 1988 (P.L.457, No.77), is amended to read:
    13     Section 2008-A.  Councils of Trustees.--(a)  The council of
    14  each of the institutions shall consist of eleven (11) members
    15  who, except for student members, shall be nominated and
    16  appointed by the Governor with the advice and consent of the
    17  Senate. At least two (2) members of the eleven (11) member
    18  council of trustees shall be alumni of the institution.


     1     (b)  Ten (10) members of each council shall serve terms of
     2  six (6) years, respectively, and until their respective
     3  successors are duly appointed and qualified. One (1) member of
     4  each council shall be a full-time undergraduate student in good
     5  academic standing, other than freshman, enrolled for at least
     6  twelve (12) semester hours at the institution of which he is a
     7  trustee. The student member shall serve a term of four (4) years
     8  or for so long as he is a full-time undergraduate student in
     9  attendance at the institution of which he is a trustee,
    10  whichever period is shorter, and is in good academic standing.
    11  [Vacancies] Except as provided for in subsection (b.1),
    12  vacancies occurring before the expiration of the term of any
    13  member shall be filled in like manner for the unexpired term.
    14  Student members of the Council of Trustees shall be appointed by
    15  the Governor and shall not be subject to Senate confirmation.
    16     (b.1)  Notwithstanding the requirements of subsection (b), in
    17  the event that a student member of the Council of Trustees is
    18  unable, for medical or other valid academic reasons, to fulfill
    19  the responsibilities of a member of the Council of Trustees, a
    20  temporary vacancy shall be declared, which shall be filled by
    21  the remaining members of the Council of Trustees by another
    22  full-time undergraduate student who meets the qualifications
    23  established in subsection (b), until the return of such member
    24  or until the expiration of the term for which he shall have been
    25  appointed, whichever shall be the shorter period.
    26     (c)  The members of each board of trustees of a former State
    27  college or university serving in such capacity on the effective
    28  date of this act shall continue to serve for the balance of
    29  their respective terms.
    30     (d)  Six (6) members of a council shall constitute a quorum.

     1  Each council shall select from its members a chairperson and a
     2  secretary to serve at the pleasure of the council. Each council
     3  shall meet at least quarterly, and additionally at the call of
     4  the president, or its chairperson, or upon request of three (3)
     5  of its members.
     6     Section 2.  This act shall take effect in 60 days.
