                                     AN ACT

     1  Amending Title 51 (Military Affairs) of the Pennsylvania
     2     Consolidated Statutes, further providing for granting of
     3     military leaves of absence.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 7302 of Title 51 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 7302.  Granting military leaves of absence.
     9     (a)  Enlistment or draft.--Whenever any employee shall, in
    10  time of war or armed conflict, or emergency proclaimed by the
    11  Governor or by the President of the United States, enlist or
    12  shall, at any time, be drafted into the active military service
    13  of the United States, he shall be automatically granted a
    14  military leave of absence. So long as an employee is on military
    15  leave of absence, he shall not be removed from his employment


     1  and his duties shall either be performed by other employees or
     2  by a temporary substitute. During such time he may receive
     3  remuneration from his civilian employer.
     4     (b)  Reserve components.--Whenever any employee who is a
     5  member of a reserve component of the armed forces shall be
     6  called or ordered to active duty by the United States and
     7  whenever any employee who is a member of the Pennsylvania
     8  National Guard shall be ordered to active State duty or special
     9  State duty by the Governor or his designee, he shall
    10  automatically be granted a military leave of absence. During
    11  such time he shall receive remuneration from his employer equal
    12  to the difference between his civilian wages and his military
    13  wages.
    14     Section 2.  This act shall take effect immediately.
