AN ACT
1 Amending Title 42 (Judiciary and Judicial Procedure) of the
2 Pennsylvania Consolidated Statutes, establishing the
3 Philadelphia Municipal Court Security Account; and providing
4 for an additional fee for initiation of legal proceeding.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Chapter 37 of Title 42 of the Pennsylvania
8 Consolidated Statutes is amended by adding a subchapter to read:

16 § 3741. Establishment of restricted receipt account.
17 There is hereby established within the General Fund a
18 restricted receipt account to be known as the Philadelphia
1 Municipal Court Security Account. All moneys deposited into the
2 account shall be used only for the physical protection of all
3 facilities and courtrooms operated by the Philadelphia Municipal
4 Court.
5 § 3742. Additional fee for initiation of legal proceeding.
6 (a) General rule.--In addition to the court costs and filing
7 fees authorized to be collected by statute, an additional fee of
8 $5 shall be charged and collected by the Philadelphia Municipal
9 Court for the initiation of a legal proceeding for which a fee
10 or cost is now authorized, except that in criminal and summary
11 matters the fee shall be charged only when a conviction is
12 obtained or a guilty plea is entered.
13 (b) Deposit into account.--The additional fee of $5
14 authorized by this section shall be deposited into the
15 Philadelphia Municipal Court Security Account.
16 § 3743. Annual appropriation.
17 Beginning with the fiscal year 2001-2002, the General
18 Assembly shall appropriate funds within the Philadelphia
19 Municipal Court Security Account in accordance with an annual
20 written expenditure plan submitted by the President Judge of the
21 Philadelphia Municipal Court to the Administrative Office of
22 Pennsylvania Courts which describes the manner in which funds
23 shall be expended for the physical protection of all facilities
24 and courtrooms operated by the Philadelphia Municipal Court.
25 Section 2. This act shall take effect in 60 days.
