HOUSE BILL

                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
     2     "An act concerning elections, including general, municipal,
     3     special and primary elections, the nomination of candidates,
     4     primary and election expenses and election contests; creating
     5     and defining membership of county boards of elections;
     6     imposing duties upon the Secretary of the Commonwealth,
     7     courts, county boards of elections, county commissioners;
     8     imposing penalties for violation of the act, and codifying,
     9     revising and consolidating the laws relating thereto; and
    10     repealing certain acts and parts of acts relating to
    11     elections," providing for Statewide use of identical voting
    12     machines; and making an appropriation.

    13     The General Assembly of the Commonwealth of Pennsylvania
    14  hereby enacts as follows:
    15     Section 1.  Article XI of the act of June 3, 1937 (P.L.1333,
    16  No.320), known as the Pennsylvania Election Code, is amended by
    17  adding sections to read:
    18     Section 1101.1.  Mandatory Statewide Use of Identical Voting
    19  Machines.--Voting in all elections shall be performed using
    20  voting machines which are identical to all other voting machines
    21  in this Commonwealth.
    22     Section 1101.2.  Study of Available Voting Machines.--The


     1  Secretary of the Commonwealth shall conduct a study of all
     2  voting machines available for purchase and shall select the
     3  machine which best combines the qualities of accuracy, ease of
     4  use by the voter and ease of counting of votes.
     5     Section 1101.3.  Purchase of Voting Machines.--The Department
     6  of General Services shall purchase a sufficient number of the
     7  voting machines selected for all election districts in this
     8  Commonwealth.
     9     Section 2.  The sum of $20,000,000, or as much thereof as may
    10  be necessary, is appropriated to the Department of General
    11  Services for fiscal year 2001-2002 for the purchase of voting
    12  machines.
    13     Section 3.  The following acts and parts of acts are
    14  repealed:
    15         (1)  Sections 1102 through 1104.1, 1108, 1109 and 1116 of
    16     the act are repealed.
    17         (2)  Sections 1101, 1105, 1106, 1107, 1110 through 1115,
    18     1117 and 1118 of the act are repealed insofar as they are
    19     inconsistent with this act.
    20     Section 4.  This act shall take effect as follows:
    21         (1)  The addition of section 1101.1 shall take effect
    22     January 1, 2004.
    23         (2)  The remainder of this act shall take effect
    24     immediately.
