AN ACT 1 Authorizing the Department of General Services, with the 2 approval of the Governor, to grant and convey to the Capital 3 Region Economic Development Corporation, on terms acceptable 4 to the Department of General Services to be established in an 5 agreement of sale, certain lands and improvements thereon 6 situate in the seventh ward of the City of Harrisburg, 7 Dauphin County. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. Conveyance in City of Harrisburg, Dauphin County. 11 (a) Conveyance authorized.--The Department of General 12 Services, with the approval of the Governor, is hereby 13 authorized on behalf of the Commonwealth of Pennsylvania to 14 grant and convey to the Capital Region Economic Development 15 Corporation, on terms acceptable to the Department of General 16 Services to be established in an agreement of sale, certain 17 lands and improvements thereon situate in the seventh ward of 18 the City of Harrisburg described in subsection (b) for fair 19 consideration equal to fair market value as determined by 20 independent appraisal.
1 (b) Property description.--The property to be conveyed 2 pursuant to subsection (a) consists of 20.838 acres, bounded and 3 more particularly described as follows: 4 ALL THAT CERTAIN PARCEL OF LAND containing 20.838 acres and 5 known as Lot 1 on the Final Subdivision Plan for the 6 Commonwealth of Pennsylvania prepared by C.W. Junkins 7 Associates, Inc., dated January 13, 2000, recorded in the 8 Dauphin County Recorder of Deeds Office in Plan Book M, Volume 9 7, and Page 25. 10 BEING a portion of the same premises, which the 11 Reconstruction Financial Corporation by its deed dated April 4, 12 1947 and recorded with the Dauphin County Recorder of Deeds 13 Office in Deed Book K, Volume 32, Page 272 granted and conveyed 14 unto the Commonwealth of Pennsylvania. 15 (c) Conditions.--The conveyance shall be made under and 16 subject to all lawful and enforceable easements, servitudes and 17 rights of others, including, but not confined to, streets, 18 roadways and rights of any telephone, telegraph, water, 19 electric, gas or pipeline companies, as well as under and 20 subject to any lawful and enforceable estates or tenancies 21 vested in third persons appearing of record, for any portion of 22 the land or improvements erected thereon. 23 (d) Deed.--The deed of conveyance shall be by special 24 warranty deed and shall be executed by the Secretary of General 25 Services in the name of the Commonwealth of Pennsylvania. 26 (e) Costs and fees.--Costs and fees incidental to this 27 conveyance shall be borne by the grantee. 28 (f) Legal effect.--If the agreement of sale cannot be 29 executed as referenced in subsection (a), the Department of 30 General Services shall publish notice in the Pennsylvania 20010H1693B2090 - 2 -
