                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     immunity involving the adjudication alternative program.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1520(e) of Title 42 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 1520.  Adjudication alternative program.
     9     * * *
    10     (e)  Immunity.--A district justice and any public service or
    11  charitable agency or organization or political subdivision
    12  supervising or administering a public service program under this
    13  section shall be immune from any civil action for damages and
    14  from workers' compensation claims brought by a person admitted
    15  to this program. Nothing in this section shall be construed to
    16  limit or otherwise affect or preclude liability resulting from
    17  gross negligence or intentional misconduct. Reckless, willful or


     1  wanton misconduct constitutes gross negligence.

     3     Section 2.  This act shall take effect immediately.
