AN ACT 1 Amending the act of January 25, 1966 (1965 P.L.1546, No.541), 2 entitled "An act providing scholarships and providing funds 3 to secure Federal funds for qualified students of the 4 Commonwealth of Pennsylvania who need financial assistance to 5 attend postsecondary institutions of higher learning, making 6 an appropriation, and providing for the administration of 7 this act," further providing for the amount of scholarship 8 awards. 9 The General Assembly of the Commonwealth of Pennsylvania 10 hereby enacts as follows: 11 Section 1. Section 7 of the act of January 25, 1966 (1965 12 P.L.1546, No.541), entitled "An act providing scholarships and 13 providing funds to secure Federal funds for qualified students 14 of the Commonwealth of Pennsylvania who need financial 15 assistance to attend postsecondary institutions of higher 16 learning, making an appropriation, and providing for the 17 administration of this act," amended October 5, 1994 (P.L.568, 18 No.83), is amended to read: 19 Section 7. (a) All scholarship awards will be based on the 20 applicant's financial need. The minimum scholarship award shall
1 be determined annually by the board of directors of the agency. 2 The maximum scholarship shall be established annually by the 3 board of directors of the agency at a level [not to exceed three 4 thousand dollars ($3,000)] so as to keep expenditures within the 5 funds available through reenactment of appropriations as 6 provided for under the act of March 28, 1974 (P.L.228, No.50), 7 relating to the forward funding of PHEAA grant program and/or 8 from funds appropriated or made available from State, Federal or 9 other sources for grants during any fiscal year. 10 (b) When, in the agency's opinion, the applicant has or will 11 have the ability to repay all or part of the desired funds or 12 where the annual scholarship allocation has been fully 13 disbursed, the agency may direct the applicant to loan funds. In 14 no case will the total State financial assistance exceed the 15 financial need of the applicant or the annual limits of this 16 act, and those of the act of August 7, 1963 [(P.L.549)] 17 (P.L.549, No.290), referred to as the Pennsylvania Higher 18 Education Assistance Agency Act. 19 Section 2.
