                                     AN ACT

     1  Authorizing the Department of General Services, with the
     2     approval of the Governor, to grant and convey to Huston
     3     Township Sewer Authority, certain lands situate in Huston
     4     Township, Clearfield County.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7  Section 1.  Lands in Huston Township, Clearfield County.
     8     (a)  Authorization.--The Department of General Services, with
     9  the approval of the Department of Conservation and Natural
    10  Resources and the Governor, is hereby authorized on behalf of
    11  the Commonwealth of Pennsylvania to grant and convey to the
    12  Huston Township Sewer Authority 41.45 acres more or less with
    13  improvements described in subsection (b) for the sum of $1.
    14     (b)  Description.--The property to be conveyed pursuant to
    15  subsection (a) consists of approximately 41.45 acres more or
    16  less with improvements, bounded and more particularly described
    17  as follows:
    18     BEGINNING, at a point in the lands also a corner of lands now
    19  or formerly of Sam Stammero; Thence, North 79 degrees 44 minutes

     1  East along said Stammero lands a distance of 125 feet to a
     2  point; THENCE, North 10 degrees 16 minutes West along said
     3  Stammero, a distance of 323.48 feet to a point in the southerly
     4  right of way line of U.S. Route 225 (L.R.412); THENCE, along
     5  said Highway, North 79 degrees 51 minutes East a distance of 414
     6  feet to a corner of lands now or formerly of the Friday Estate;
     7  THENCE, South 9 degrees 31 minutes East a distance of 164 feet
     8  to an iron pin; THENCE, North 80 degrees 43 minutes East a
     9  distance of 211.85 feet to an iron pin; North 23 degrees 44
    10  minutes East a distance of 143 feet to the southerly edge of
    11  said Highway right of way; THENCE, South 86 degrees 52 minutes
    12  East a distance of 481 feet along said Highway; THENCE, North 86
    13  degrees 16 minutes East a distance of 244 feet to a point
    14  intersecting the centerline of State Highway, L.R. 17142 at its
    15  intersection with U.S. Route 255; THENCE, South 22 degrees 24
    16  minutes East, along said centerline of L.R. 17142, a distance of
    17  339 feet to a point; THENCE, through lands of The New Shawmut
    18  Mining Company, South 60 degrees 14 minutes West a distance of
    19  745 feet to a point; THENCE, South 1 degree 48 minutes East a
    20  distance of 520 feet to a point in the centerline of the
    21  Baltimore & Ohio Railroad right of way; THENCE, By the same
    22  course, South 1 degree 48 minutes a distance of 487 feet to a
    23  point on the southerly side of Bennetts Run; THENCE, South 74
    24  degrees 44 minutes West a distance of 763 feet to a point;
    25  THENCE, North 10 degrees 16 minutes West a distance of 666 feet
    26  to a point in the centerline of said railroad; THENCE, by the
    27  same course, North 10 degrees 16 minutes West a distance of
    28  842.5 feet to the point and place of beginning.
    29     CONTAINING 41.45 acres, more or less.
    30     (c)  Easements.--The conveyance shall be made under and

     1  subject to all lawful and enforceable easements, servitudes and
     2  rights of others, including, but not confined to streets,
     3  roadways and rights of any telephone, telegraph, water,
     4  electric, gas or pipeline companies, as well as under and
     5  subject to any lawful and enforceable estates or tenancies
     6  vested in third persons appearing of record, for any portion of
     7  the land or improvements erected thereon.
     8     (d)  Execution.--The deed of conveyance shall be by Special
     9  Warranty Deed and shall be executed by the Secretary of General
    10  Services in the name of the Commonwealth of Pennsylvania.
    11  Covenants, conditions and restrictions as they appear in article
    12  (13), Agreement of Sale, by and between the Commonwealth of
    13  Pennsylvania and Huston Township Sewer Authority shall be
    14  contained in the deed of conveyance. Said article (13)
    15  stipulates a portion of the premises will be dedicated to the
    16  exclusive use by the Department of Conservation and Natural
    17  Resources, Bureau of Topographic and Geologic Survey in
    18  perpetuity.
    19     (e)  Costs.--Costs and fees incidental to this conveyance
    20  shall be borne by the Grantee.
    21     (f)  Alternate disposition.--In the event that this
    22  conveyance is not executed within 12 months of the effective
    23  date of this act, the property may be disposed of in accordance
    24  with Article 2406-A of the act of April 9, 1929 (P.L.177,
    25  No.175), known as The Administrative Code of 1929.
    26  Section 2.  Effective date.
    27     This act shall take effect immediately.
