        INTRODUCED BY PETRONE, TANGRETTI, STABACK, BELARDI, LAUGHLIN,
           WOJNAROSKI, FRANKEL, MELIO, WOGAN, WASHINGTON, STEVENSON,
           HARHAI, KELLER, HORSEY, RAMOS, HENNESSEY, M. COHEN AND JAMES,

                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, adding definitions related to "biometrics,"
     3     "fingerprint imaging" and "smart card technology"; and
     4     further providing for the use of smart card technology and a
     5     fingerprint image on Pennsylvania commercial and
     6     noncommercial drivers' licenses.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 102 of Title 75 of the Pennsylvania
    10  Consolidated Statutes is amended by adding definitions to read:
    11  § 102.  Definitions.
    12     Subject to additional definitions contained in subsequent
    13  provisions of this title which are applicable to specific
    14  provisions of this title, the following words and phrases when
    15  used in this title shall have, unless the context clearly
    16  indicates otherwise, the meanings given to them in this section:
    17     * * *
    18     "Biometrics."  The science and technology for measuring and
    19  analyzing human body characteristics, including, but not limited

     1  to, fingerprints, eye retinas and irises, voice patterns, facial
     2  patterns or hand measurements for the purpose of personal
     3  identity authentication.

     5     "Fingerprint imaging."  A biometric process by which
     6  fingerprints are scanned, identifying features (minutiae) are
     7  extracted and measurements of the minutiae points relative to
     8  each other are mapped for comparison.
     9     * * *
    10     "Smart card technology."  A small electronic device about the
    11  size of a credit card that contains electronic memory on an
    12  embedded integrated circuit.
    13     * * *
    14     Section 2.  Section 1510(a) and (b) of Title 75 are amended
    15  and the section is amended by adding subsections to read:
    16  § 1510.  Issuance and content of driver's license.
    17     (a)  General rule.--The department shall, upon payment of the
    18  required fee, issue to every qualified applicant a driver's
    19  license [indicating the type or general class of vehicles the
    20  licensee is authorized to drive and any endorsements or
    21  restrictions, which license shall contain a distinguishing
    22  number assigned by the department to the licensee, the actual
    23  name, date of birth, residence address, a color photograph or
    24  photographic facsimile of the licensee, such other information
    25  as may be required by the department, and either a facsimile of
    26  the signature of the licensee or a space upon which the licensee
    27  shall write his usual signature with pen and ink.] which
    28  complies with the requirements of subsections (a.1), (a.2) and
    29  this subsection. The driver's license shall be designed and
    30  manufactured utilizing smart card technology which utilizes a

     1  departmental managed smart card technology data base to retrieve
     2  the pertinent information under subsections (a.1) and (a.2).
     3  Personal medical data and other information for use in an
     4  emergency may be included as a part of the license. Information
     5  other than that required to identify the licensee, the
     6  distinguishing number and the class of license issued may be
     7  included in microdata form. Except as provided in subsection
     8  (f), an applicant shall include his Social Security number on
     9  his license application[, but the Social Security number shall
    10  not be included on the license]. No driver's license shall be
    11  valid until it has been signed by the licensee.
    12     (a.1)  Visual information on license.--A driver's license
    13  issued under subsection (a) shall contain in visual format all
    14  of the following:
    15         (1)  A distinguishing number assigned by the department
    16     to the licensee.
    17         (2)  A color photograph or photographic facsimile of the
    18     licensee.
    19         (3)  A facsimile of the signature of the licensee.
    20         (4)  The expiration date of the license.
    21         (5)  Any other information the department deems
    22     necessary.
    23     (a.2)  Information stored on smart card.--The smart card
    24  required under this section shall be capable of storing in a
    25  secure manner all of the following information:
    26         (1)  A distinguishing number assigned by the department
    27     to the licensee.
    28         (2)  The actual name of the licensee.
    29         (3)  The date of birth of the licensee.
    30         (4)  The residential address of the licensee.

     1         (5)  A physical description of the person, including sex,
     2     height and eye color.
     3         (6)  A facsimile of the signature of the licensee.
     4         (7)  Social Security number.
     5         (8)  Fingerprint image.
     6         (9)  The type or general class of vehicles the licensee
     7     is authorized to drive.
     8         (10)  Any restrictions or endorsements.
     9         (11)  The expiration date of the license.
    10         (12)  Any other information the department deems
    11     necessary.
    12     (b)  Identification card.--The department shall, upon payment
    13  of the required fee, issue an identification card to any person
    14  who has made application therefor in such manner as the
    15  department shall prescribe or whose driver's license has been
    16  surrendered to the department because of a suspension or
    17  revocation of an operating privilege under this or any other
    18  title. The identification card shall be designed and
    19  manufactured in the same manner and of the same components as a
    20  driver's license and shall have substantially the same content
    21  as a driver's license but shall clearly indicate that it is not
    22  a driver's license. Upon failure of any person to pass any
    23  examination required under section 1514 (relating to expiration
    24  and renewal of drivers' licenses), the department shall, where
    25  appropriate, issue a complimentary identification card as an
    26  expression of gratitude for years of safe driving. The card
    27  shall only be issued upon receipt of the person's driver's
    28  license.

    30     Section 3.  Section 1610(a) of Title 75 is amended to read:

     1  § 1610.  Commercial driver's license.
     2     (a)  Content of license.--The commercial driver's license
     3  shall indicate "commercial driver's license" or "CDL", shall
     4  comply with the design and manufacturer's standards under
     5  section 1510(a) and (a.1) (relating to issuance and content of
     6  driver's license) and the smart card technology requirements
     7  under section 1510(a.1) and (a.2) and shall include, but not be
     8  limited to, the following additional information:
     9         (1)  [The name and residential address of the person.
    10         (2)  The person's color photograph or photographic
    11     facsimile.
    12         (3)  A physical description of the person, including sex,
    13     height and eye color.
    14         (4)  Date of birth.
    15         (5)  The license number assigned by the department.
    16         (6)  The person's signature or a facsimile of that
    17     signature.
    18         (7)]  The class or type of commercial motor vehicle or
    19     vehicles which the person is authorized to drive, together
    20     with any endorsements or restrictions.

    22     Section 4.  The Department of Transportation shall provide a
    23  schedule to phase-in the new drivers' licenses over a four-year
    24  period which follows the expiration dates for drivers' licenses
    25  issued on and after January 1, 2002.
    26     Section 5.  This act shall take effect July 1, 2000.
