                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for school bus requirements.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Section 4552 of Title 75 of the Pennsylvania
     6  Consolidated Statutes is amended by adding a subsection to read:
     7  § 4552.  General requirements for school buses.
     8     * * *
     9     (b.4)  Use of child restraint systems.--Every school bus
    10  shall be equipped with a child restraint system that is in
    11  conformity with 49 CFR 571.222 (relating to school bus passenger
    12  seating and crash protection). The child restraint system is
    13  mandated according to the following schedule:
    14         (1)  School buses may be equipped with a child restraint
    15     system after December 31, 1999.
    16         (2)  Every new school bus purchased and manufactured
    17     after June 30, 2001, shall be equipped with a child restraint


     1     system.
     2         (3)  By July 1, 2005, every school bus shall be equipped
     3     with a child restraint system. Every school student shall be
     4     required to use the child restraint system when the school
     5     bus is in motion. Nothing in this subsection shall make the
     6     owner or operator of a school bus liable for failure to
     7     properly adjust and fasten a seat belt or other child
     8     restraint system that is in conformity with applicable
     9     Federal standards for a passenger who sustains injury as a
    10     direct result of the passenger's failure to comply with the
    11     requirement established by this section. The department shall
    12     adopt regulations implementing this subsection.
