                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for abandoned infants.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Title 18 of the Pennsylvania Consolidated
     6  Statutes is amended by adding a section to read:
     7  § 511.  Abandoned infants.
     8     (a)  General rule.--Except as provided in subsection (b), it
     9  is justifiable for an individual who has physical custody of an
    10  infant less than 16 days of age to leave that infant with a
    11  provider of emergency medical services.
    12     (b)  Exception.--Subsection (a) does not apply to an offense
    13  under any of the following:
    14         (1)  Chapter 25 (relating to criminal homicide).
    15         (2)  Chapter 29 (relating to kidnapping).
    16     (c)  Definitions.--As used in this section, the following

     1  words and phrases shall have the meanings given to them in this
     2  subsection:
     3     "Emergency medical services."  The services utilized in
     4  responding to the needs of an individual for immediate medical
     5  care in order to prevent loss of life or aggravation of
     6  physiological or psychological illness or injury.
     7     "Emergency medical services provider."  A person that
     8  regularly provides emergency medical services.
     9     Section 3.  This act shall take effect in 60 days.
