AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further defining "school bus" to exclude certain 3 vehicles used for religious purposes. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. The definition of "school bus" in section 102 of 7 Title 75 of the Pennsylvania Consolidated Statutes is amended to 8 read: 9 § 102. Definitions. 10 Subject to additional definitions contained in subsequent 11 provisions of this title which are applicable to specific 12 provisions of this title, the following words and phrases when 13 used in this title shall have, unless the context clearly 14 indicates otherwise, the meanings given to them in this section: 15 * * * 16 "School bus." A motor vehicle which: 17 (1) is designed to carry 11 passengers or more, 18 including the driver; and
1 (2) is used for the transportation of preprimary, 2 primary or secondary school students to or from public, 3 private or parochial schools or events related to such 4 schools or school-related activities. 5 The term does not include a motor vehicle used to transport 6 preprimary, primary or secondary school students to or from 7 public, private or parochial schools or events related to such 8 schools or school-related activities, which is designed to carry 9 11 to 15 passengers, including the driver, and which is 10 registered in this Commonwealth as a bus prior to March 1, 1993, 11 or a motor vehicle which is designed to carry 11 to 15 12 passengers, including the driver, and which was titled to any 13 public, private or parochial school on or before March 1, 1993, 14 and which is registered to that public, private or parochial 15 school in this Commonwealth as a bus prior to September 15, 16 1993. The term also does not include a motor vehicle operated by 17 or on behalf of a religious organization and used to transport 18 passengers to or from any location for religious purposes, 19 including, but not limited to, religious instruction or 20 education, worship and religious youth activities, and which is 21 designed to carry 11 to 15 passengers, including the driver. 22 * * * 23 Section 2.
