AN ACT 1 Amending the act of June 14, 1961 (P.L.324, No.188), entitled 2 "An act relating to the establishment, operation and 3 maintenance of the State Library and public libraries in the 4 Commonwealth; amending, revising, consolidating and changing 5 the laws relating thereto; imposing duties upon public 6 officers; providing for State and local cooperation and 7 assistance in the establishment and maintenance of libraries; 8 prescribing penalties; and repealing existing laws," defining 9 "Internet"; and requiring library policies regarding Internet 10 access by minors. 11 The General Assembly of the Commonwealth of Pennsylvania 12 hereby enacts as follows: 13 Section 1. Section 102 of the act of June 14, 1961 (P.L.324, 14 No.188), known as The Library Code, is amended by adding a 15 clause to read: 16 Section 102. Definitions.--As used in this act-- 17 * * * 18 (8) "Internet." The international nonproprietary computer 19 network of both Federal and non-federal interoperable packet- 20 switched data networks.
1 Section 2. Section 304(b) of the act, amended December 1, 2 1971 (P.L.578, No.150), is amended to read: 3 Section 304. State Librarian to Approve Plans; District 4 Library Center Cooperative Program; Referendum.--* * * 5 (b) No State-aid shall be given to any library unless the 6 local library board commits the library to participation in the 7 District Library Center Cooperative Program including attendance 8 at district meetings and the use of interlibrary loans and 9 interlibrary references and, if the local library provides 10 access to the Internet or an on-line service, adopts a policy 11 regarding access by minors to Internet and on-line sites that 12 contain or make reference to explicit sexual materials as 13 defined in 18 Pa.C.S. § 5903 (relating to obscene and other 14 sexual materials and performances). 15 * * * 16 Section 3.
