        REFERRED TO COMMITTEE ON INSURANCE, APRIL 13, 1999

                                     AN ACT

     1  Amending the act of April 22, 1994 (P.L.136, No.20), entitled
     2     "An act mandating health insurance coverage of annual
     3     gynecological examinations and routine pap smears; and making
     4     repeals," further providing for legislative findings and for
     5     mandated coverage.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Sections 2 and 4 of the act of April 22, 1994
     9  (P.L.136, No.20), known as the Women's Preventative Health
    10  Services Act, are amended by adding paragraphs to read:
    11  Section 2.  Declaration of policy.
    12     The General Assembly finds and declares as follows:

    14     (8)  Technological advances in medical science have led to


     1  the development of newer tests which yield results superior to
     2  those obtained with the conventional cerviocovaginal
     3  papanicolaou test or pap smear.
     4     (9)  In 1996, the United Stated Food and Drug Administration
     5  approved the fluid-based, thin-layer preparation test as a
     6  replacement for the conventional cerviocovaginal papanicolaou
     7  test or pap smear.
     8  Section 4.  Mandated coverage.
     9     A health insurance policy which is delivered, issued for
    10  delivery, renewed, extended or modified in this Commonwealth by
    11  a health care insurer shall provide that the health insurance
    12  benefits applicable under the policy include coverage for
    13  periodic health maintenance to include:

    15         (3)  Other cervical cancer screening methods approved by
    16     the United States Food and Drug Administration. Such
    17     screening shall include fluid-based, thin-layer preparation
    18     tests.
    19     Section 3.  This act shall take effect in 120 days.
