SENATE AMENDMENTS TO HOUSE AMENDMENTS, JUNE 9, 1998
AN ACT 1 Amending Title 51 (Military Affairs) of the Pennsylvania 2 Consolidated Statutes, further providing for advisory 3 councils for veterans' homes and for pay of members on 4 special duty; AND PROVIDING FOR THE CHARITABLE STATUS OF <-- 5 CERTAIN VETERANS' ORGANIZATIONS. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Sections 704(a) and 3101 of Title 51 of the 9 Pennsylvania Consolidated Statutes are amended to read: 10 § 704. Advisory councils for veterans' homes. 11 (a) Establishment of advisory council.--There is hereby 12 established an advisory council for each veterans' home operated 13 by the Commonwealth. Each advisory council shall consist of [11] 14 15 members and the Adjutant General, who shall serve ex officio. 15 [Eight] Twelve of the members shall be appointed by the Governor 16 from a list of nominations submitted to the Adjutant General by 17 the Pennsylvania War Veterans' Council. The Speaker of the House 18 of Representatives and the President pro tempore of the Senate 19 shall each appoint one member from their respective bodies to
1 serve on each council. The remaining member on the advisory 2 council shall be selected by the residents of the veterans' 3 homes. 4 * * * 5 § 3101. Pay of officers and enlisted personnel on special duty. 6 [Commissioned officers] Members of the Pennsylvania National 7 Guard or Pennsylvania Guard may be ordered upon special duty at 8 the discretion of the Governor and shall receive the pay and 9 allowances of their respective grades during the time they may 10 continue upon duty under such order. 11 SECTION 2. TITLE 51 IS AMENDED BY ADDING A SECTION TO READ: <-- 12 § 9303. CHARITABLE STATUS OF CERTAIN VETERANS' ORGANIZATIONS. 13 NOTWITHSTANDING ANY OTHER LAW TO THE CONTRARY, ANY 14 ORGANIZATION THAT IS ESTABLISHED AND OPERATED BY ANY BRANCH, 15 POST OR CAMP OF HONORABLY DISCHARGED SERVICEMEN OR SERVICEWOMEN 16 AND THE MEMBERSHIP OF THAT ORGANIZATION IS COMPOSED OF AT LEAST 17 75% PAST OR PRESENT MEMBERS OF THE UNITED STATES ARMED FORCES 18 SHALL BE: 19 (1) EXEMPT FROM SALES AND USE TAXES IMPOSED UNDER 20 ARTICLE II OF THE ACT OF MARCH 4, 1971 (P.L.6, NO.2), KNOWN 21 AS THE TAX REFORM CODE OF 1971. 22 (2) EXEMPT FROM ANY REAL PROPERTY TAXES FOR THAT PORTION 23 OF THE REAL PROPERTY THAT IS ACTUALLY AND REGULARLY USED FOR 24 BENEVOLENT, CHARITABLE OR PATRIOTIC PURPOSES. 25 (3) DEEMED AN INSTITUTION OF PURELY PUBLIC CHARITY FOR 26 ALL PURPOSES UNDER THE ACT OF NOVEMBER 26, 1997 (P.L.508, 27 NO.55), KNOWN AS THE INSTITUTIONS OF PURELY PUBLIC CHARITY 28 ACT. 29 Section 2 3.
