SENATE BILL

        INTRODUCED BY ROBBINS, LEMMOND, WAGNER, BELL, SLOCUM, STOUT,
           SALVATORE, PUNT, STAPLETON, GERLACH, RHOADES AND MUSTO,
           MAY 12, 1997

        AS AMENDED ON THIRD CONSIDERATION, OCTOBER 20, 1997

                                     AN ACT

     1  Amending Title 51 (Military Affairs) of the Pennsylvania
     2     Consolidated Statutes, further providing for maintenance,      <--
     3     CONSTRUCTION AND REPAIR contracts to be performed by the
     4     Armory Board; AND MAKING A REPEAL.                             <--

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 1512 of Title 51 of the Pennsylvania
     8  Consolidated Statutes is amended to read:
     9  § 1512.  Maintenance, CONSTRUCTION and repairs.                   <--
    10     Notwithstanding the provisions of any other law to the
    11  contrary, the Armory Board may carry out all maintenance
    12  activities with respect to an armory if the cost does not exceed
    13  $100,000[.], and may carry out contracts for repair or
    14  construction of armories and other State-owned buildings or
    15  facilities under the jurisdiction of the department up to an
    16  amount of $100,000.
    17     Section 2.  Nothing in this act shall be construed to grant
    18  the Department of Military and Veterans Affairs the authority to


     1  construct or enter into contracts for the construction of new
     2  armories or to enter into contracts for the construction or
     3  acquisition of any armory, building or facility that may be
     4  deemed a capital project pursuant to Article XVI-B of the act of
     5  April 9, 1929 (P.L.343, No.176), known as The Fiscal Code.
     6     SECTION 3.  SECTION 508 OF THE ACT OF APRIL 9, 1929 (P.L.177,  <--
     7  NO.175), KNOWN AS THE ADMINISTRATIVE CODE OF 1929, IS REPEALED
     8  TO THE EXTENT IT CONFLICTS WITH THE AMENDMENT OF 51 PA.C.S. §
     9  1512 CONTAINED IN SECTION 1 OF THIS ACT.
    10     Section 3 4.  This act shall take effect immediately.          <--
