SENATE BILL

        INTRODUCED BY BRIGHTBILL, SALVATORE, WENGER, WOZNIAK, MUSTO,
           SCHWARTZ, O'PAKE, HECKLER, ROBBINS, RHOADES, MOWERY,
           AFFLERBACH, HART, HUGHES, KITCHEN, MURPHY, WHITE AND
           WILLIAMS, FEBRUARY 10, 1997

        AS AMENDED ON THIRD CONSIDERATION, JUNE 2, 1997

                                     AN ACT

     1  Repealing certain mandates imposed on counties; and discharging
     2     certain liabilities of counties.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Repeals.
     6     (a)  Absolute.--The following acts and parts of acts are       <--
     7  repealed:
     8     Section 505 505(A) of the act of October 20, 1966 (3rd         <--
     9  Sp.Sess., P.L.96, No.6), known as the Mental Health and Mental
    10  Retardation Act of 1966.
    11     Section 408 of the act of July 9, 1976 (P.L.817, No.143),
    12  known as the Mental Health Procedures Act.
    13     (b)  Other.--As much as relates to public nursing homes in     <--
    14  section 472 of the act of June 13, 1967 (P.L.31, No.21), known
    15  as the Public Welfare Code, is repealed.
    16  Section 2.  Discharge of certain liabilities of counties and
    17                 county authorities.

     1     All liability of counties and county authorities under
     2  section 505 505(A) of the act of October 20, 1966 (3rd Sp.Sess.,  <--
     3  P.L.96, No.6), known as the Mental Health and Mental Retardation
     4  Act of 1966, in existence on the effective date of this act, is
     5  discharged.
     6  Section 3.  Effective date.
     7     This act shall take effect immediately.
