                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for junior driver's license.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Section 1503(c) of Title 75 of the Pennsylvania
     6  Consolidated Statutes is amended to read:
     7  § 1503.  Persons ineligible for licensing.
     8     * * *
     9     (c)  Junior driver's license.--The department may issue a
    10  junior driver's license to a person 16 or 17 years of age under
    11  rules and regulations adopted by the department and subject to
    12  the provisions of this section. A junior driver's license shall
    13  automatically become a regular driver's license when the
    14  licensee attains 18 years of age.
    15         (1)  Except as provided in paragraph (2), no licensed
    16     junior driver shall drive a vehicle upon a public highway
    17     between 12 midnight and 5 a.m. unless accompanied by a spouse


     1     18 years of age or older, a parent or a person in loco
     2     parentis.
     3         (2)  A licensed junior driver conforming to the
     4     requirements of section 1507 (relating to application for
     5     driver's license or learner's permit by minor) may drive a
     6     vehicle upon a public highway between 12 midnight and 5 a.m.
     7     between their home and their activity or employment or in the
     8     course of their activity or employment if they are a member
     9     of a volunteer fire company authorized by the fire chief to
    10     engage in fighting fires, engaged in public or charitable
    11     service or employed and they are carrying an affidavit signed
    12     by their fire chief, supervisor or employer indicating the
    13     probable schedule of their activities. Upon termination of
    14     the junior driver's activity or employment, the junior
    15     licensee shall surrender the affidavit to the fire chief,
    16     supervisor or employer. If the junior licensee shall fail to
    17     surrender the affidavit, the employer, fire chief or
    18     supervisor shall immediately notify the Pennsylvania State
    19     Police.
    20         (3)  In addition to the other provisions of this title
    21     relating to the suspension or revocation of operating
    22     privileges, in the event that a licensed junior driver is
    23     involved in an accident for which they are partially or fully
    24     responsible in the opinion of the department or is convicted
    25     of any violation of this title, the department may suspend
    26     the operating privileges of such person until the person
    27     attains 18 years of age or for a period of time not exceeding
    28     90 days.
    29         (4)  Any junior licensee or other person violating any
    30     provision of this subsection is guilty of a summary offense.

     1         (5)  A person shall not be eligible to apply for a junior
     2     driver's permit unless he completes 50 hours of community
     3     service or has been employed for 50 hours since the day of
     4     his 15th birthday. If 50 hours of community service or
     5     employment have not been completed, the person must wait to
     6     apply for a driver's license until reaching the age of 18.
     7     Section 2.  This act shall take effect in 60 days.
