AN ACT 1 Authorizing the Department of General Services, with the 2 approval of the Governor and the Department of Conservation 3 and Natural Resources, to grant and convey a sanitary sewer 4 right-of-way over certain State land to Penn Township, York 5 County, Pennsylvania. 6 The General Assembly finds the following: 7 (1) The Codorus State Park is owned by the Commonwealth 8 and administered under the jurisdiction of the Department of 9 Conservation and Natural Resources. Codorus State Park was 10 purchased with funds appropriated pursuant to the act of June 11 22, 1964 (Sp.Sess., P.L.131, No.8), known as the Project 70 12 Land Acquisition and Borrowing Act. 13 (2) The Project 70 Land Acquisition and Borrowing Act 14 restricts use of land purchased with the appropriated funds 15 to recreation, conservation or historical purposes, except as 16 otherwise provided by express authorization of the General 17 Assembly or by specific exemption listed in section 20(b) of 18 the act. 19 The General Assembly of the Commonwealth of Pennsylvania
1 hereby enacts as follows: 2 Section 1. The Department of General Services, with the 3 approval of the Governor and the Department of Conservation and 4 Natural Resources, is hereby authorized and directed on behalf 5 of the Commonwealth of Pennsylvania to grant and convey to Penn 6 Township, York County, for a consideration of $1, a sanitary 7 sewer right-of-way on a parcel of land situate in Penn Township, 8 York County, Pennsylvania, being bounded and described as 9 follows: 10 All that certain strip of land thereto situate in the 11 Township of Penn, County of York, Commonwealth of Pennsylvania, 12 being bounded and described as follows to wit: 13 Beginning from a point on the centerline of a proposed 20 14 foot wide permanent sanitary sewer right-of-way, said point 15 being located South 22 degrees 55 minutes 16 seconds East, 38.95 16 feet from a corner of Codorus State Park designated as F&W - 17 169, thence continuing across lands of the Codorus State Park, 18 North 48 degrees 49 minutes 42 seconds East, 19.83 feet to a 19 proposed manhole, thence continuing by the same North 86 degrees 20 22 minutes 56 seconds East, 308.41 feet to an existing Penn 21 Township sanitary sewer manhole designated as Manhole No. 111, 22 said manhole being the terminus of the above described right-of- 23 way. 24 Along with an additional 10 foot wide temporary construction 25 easement located on the southern side of the above described 20 26 foot wide permanent right-of-way. Reference is hereby made to 27 the attached plan of sanitary sewer right-of-way prepared by 28 Group Hanover, Inc. Engineers and Surveyors, dated February 6, 29 1998. 30 Section 2. The conveyance shall be made under and subject to 19980H2507B3379 - 2 -
1 all easements, servitudes and rights of others, including, but 2 not confined to, streets, roadways and rights of any telephone, 3 telegraph, water, electric, sewer, gas or pipeline companies, as 4 well as under and subject to any interest, estates or tenancies 5 vested in third persons, whether or not appearing of record, for 6 any portion of the land or improvements erected thereon. 7 Section 3. The proceeds of this sale shall be paid into the 8 State Treasury. 9 Section 4. The deed of conveyance shall be approved as 10 provided by law and shall be executed by the Secretary of 11 General Services in the name of the Commonwealth of 12 Pennsylvania. 13 Section 5. Costs and fees incidental to this conveyance 14 shall be borne by the grantee. 15 Section 6. This act shall take effect immediately. D8L85SFL/19980H2507B3379 - 3 -
